Thanks!Coupon-mad said:What does your tenancy agreement say, if anything, about parking rights, regulations or permits? Were you handed a permit at any stage? Was the landlord?
Are the leaseholders all telling the Managing Agents to get stuffed? They cannot impose an onerous parking scheme without consent. This is what the leasehold owners need to rise up and do as one:
https://forums.moneysavingexpert.com/discussion/5997200/pcm-company-introduced
Show that to your landlord as this cannot be imposed without consent.
I've read my tenancy agreement it specifies nothing about parking, parking permits or any associated charges. Also I was never told about any permit or given one when I first let the property (18 months ago). The landlord maintains that she received no formal notification of the new system being introduced but is going to double check this and the lease to be certain.1 -
Have you looked for anything about use of communal spaces, such as a carpark? You cannot solely look for the word "parking"
What were you told about parking when you rented?
Do you have ANY of your comms in writing? 3rd time...1 -

Thanks,Fruitcake said:Please answer all questions asked by the regulars on here. Remember that you have information that we do not. We need the information asked for in order to help you.
Have you complained to your MP yet about this unregulated scam?
You really do need to read the NEWBIES thread. We get about a hundred requests for help every day. Between work and family commitments many of us don't have the time to spoon feed posters which is why the NEWBIES is there to help you. If we answered every question asked by every poster, this forum would collapse. The NEWBIES already answers most of your questions so we don't have to repeat ourselves day in day out.
You don't need to read it all but you do need to read the parts that are relevant to your case.
Never, ever 'phone a parking scammer.
Never, ever contact a debt collector, ever.
I haven't complained to my local MP yet but will do so by the end of this week. Are there any threads with draft letters I can use to do this?0 -
Yes, but write your own. Much better than a template, dont you think?2

thats the first route
did your landlord tell you that in writing? If so seems the MA broke the law -L&TA - by not polling people before changing their lease. Introducing a permit system requires the lease to be changed.0 -

Agreed, but was more just to get a feel for what others write then of course make own original version.nosferatu1001 said:Yes, but write your own. Much better than a template, dont you think?0 -

ZERO evidence they have even done this so far but awaiting the landlord to comeback to me on this. Her current stance is she'd refuse to pay (rightly) for a ticket that's on her own PRIVATE land without knowledge this new permit system was going to be implemented however this alone isn't enough to get the ticket cancelled and get rid of these scammers.Le_Kirk said:
When did the maintenance company (maintenance company, MAINTENANCE, not even the Management Company) carry out the consultation about parking companies infesting your residence? When did they ask the tenants/owners/residents if they wanted to be infested by sharks? Did 75% of the residents agree with no more than 10% disagreeing?freedomfighter82 said:

have you looked at your lease granted rights?
I've just spoken to the landlord who informed me that the maintenance company introduced this new private permit system in February WITHOUT informing her or any of the other owners/landlords in the block. Is this another legal route I can go down?0 -
            4th time.
You even quoted.
Do you have your landlords comms in writing? Yes or No
Have you checked your AST for any rights granted over communal spaces etc?
Does she own the speciifc space? As in, is it an allocated space to her flat and hers alone, demised in her (long) lease?

It would appear that the "maintenance company" (are you sure that they are not the managing company), acted unlawfully, read this
https://forums.landlordzone.co.uk/forum/residential-letting-questions/1053920-private-parking-companies
and consider taking it up with your landlord.
You never know how far you can go until you go too far.1 -
