If it hasn't got to the submission stage yet you could reply to them that you wish to make a complain and give the reasons. THey are required to act on your complaint. If they submitted the court papers during this period, you could request that the court puts a stay on it pending the outcome of the complaint or throw the court case out due to them giving insufficient opportunity to resolve using a free-of-charge regulated independent arbiter.
Hopefully, one of the other regulars here will give you a link to the thread that showed the successful court case.
Thanks for the input .....very helpfull0 -
If anyone has a complaint about falsified paperwork, especially if they have been issued court proceedings they intend to defend, I will be interested to hear of this.
Whilst each case needs to have an individual defence, pleading the existence of and even the joinder of like cases may assist to bring about a prosecution. The FCA are as useless as I predicted before I phoned them. Call takers are painfully thick. Accessing the National Crime Agency involves speaking to some disinterested plonk cop in your local force - if you even get past the civillian call taker trained to say every report is a “civil matter” so far too many hurdles to waste the effort, but a judge can make a report directly to the Director of Public Prosecutions if they believe a case has been brought before them based upon a fraud - I have seen this done in the past. Drop me a message if you are so inclined.0 -

I fully intend to defend the case , the whole reason I decided not to proceed with fast track reclaim was because I had found stories such as this, typical I find myself in the same situation. I feel particularly annoyed by the fact that they forged my LOA effectively removing my right to stop proceedings within 14 days which they have printed on the LOA . I say removed my rights to cancel as I had no idea the form had been activated .
I'm not sure how the court will view this and the fact by firging the LOA also removed my right to choose who I do business with......however I will attend court and argue theses facts
I'll certainly update here after

All a CMC does is send in your PPI complaint. Sometimes as little as your name and address on a spreadsheet. It then sits back and waits for the outcome. You confirm your CMC did what was expected of it and that you employed them to do that. So, yes, of course, you need to pay them. You have no grounds to refuse.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -
Has anyone had these charges removed either by the complaint or ombudsman? I find myself in the same position with them filling in the LOA on my behalf and now trying to claim money I pursued myself from the bank.1

Hi all
I also looked into fast track reclaim but shortly after decided to look into ppi myself as I knew they'd take a hefty Chunk off me. Ignored all correspondence from them and now received an email from Joseph James law solicitor asking me to send my lenders final decision letter and I will be liable to pay them a fee. As like many of you I have never signed anything and in 1 phone call I asked them to cancel my details off their site and that I am looking into it myself. The solicitor email is saying if they don't have my final decision letter from my lender within 14 days I will be taken to court! I know I haven't signed anything. Please help-1
