dunstonh said:However, do not ignore it.Respond to them in writing (keeping a copy) saying that you have made a formal complaint using the regulated complaints process and are awaiting their response to the complaint. And that their threat of legal action whilst the complaints process is in progress could be seen as a regulatory breach under the FCA's treating customer's fairly guidelines. Also, state that you will be using the Financial Ombudsman Service if their response is not satisfactory but you will abide by the FOS decision. When the small claims court is used, the firm will need to show it has considered alternative mediation and methods of settlement. With you saying that you have a complaint oustanding and they have not responded and that you are willing to abide by the decision of the FOS, it shows you are willing to use the independent arbiter of complaints. You can request that the case is struck out for being made prematurely whilst mediation is still in progress via the FOS. It also paints them in a bad light as they have failed to respond to your complaint but have proceeded with legal action.0

Hello. Reading through this thread and it's all very familiar all of a sudden.
I logged into Fast Track Reclaim some time in July- just before the PPI deadline.
I used their search for PPI facility but then worked through all of my paperwork, sorted it all out for myself and claimed directly. 2 lenders have contacted me to acknowledge my claim and to keep me updated regarding delays/proposed completion date.
I only went partially through the FTR process in a bit of a panic because we were nearing the PPI deadline and I was struggling to go through my paperwork. I recieved nothing from them regarding a fee and signed nothing.
I've recieved numerous "Hey we need more info to proceed - we've identified you did have PPI" letters and emails from FTR.
I've signed nothing and replied to no emails.
Working from home these last couple of months, I've had one number calling me persistently which I answered yesterday.
When I explained I'd made my own claim, the guy on the phone told me that, even if I cancelled the claim now, if I recieved a payout, FTR would take 24% fee because:
1. They had identified I had PPI
2.I had signed an agreement last July.
3. It was payment for all the work they have done.
In yesterday's phone call I was hesitant to do anything at all because I smelt a rat. The person I spoke to said that they would take a note of the fact I had claimed directly. I'm assuming what he meant was a note to say I'd been told over the phone about the fee.
I could kick myself BUT I'm glad I've found this thread. I'd just like to know if anyone could advise my next step.
Just an added bit of info. The two claims made directly which FTR reckon they've been working hard on all these months are in both mine and my husband's name. He hasn't replied to any of their emails or letters either. Neither lender has asked for any further information and are investigating using my original online claim.
FTR have not had to put any "work" into this at all apart from keep hassling us for more information "in order to proceed"
I'd be really grateful of any advice.
Thankyou in advance.

As with the OP, you need to ask them to produce evidence of the contract they believe you signed.3 -

i have had the exact same experience as everyone else , free ppi check .....i did not sign the letter of authority after somebody suggested i looked into the company , and found lots of stories such as these .
again Fast Track Reclaim has put my electronic signature from the "free Search " enquiry and used a computer generated font to date the letter of authority
i pointed this out to them that it was not signed or dated by myself . many letters and threats of legal action......i have now received court paperwork
any advice would be much appreciated , im intending to dispute the case and put forward the arguement that they have acted withought my permission . By forging the letter of authority they removed my ability to use the 14 day cool off period as i had no idea the LOA had been activated0 -
There has been a recent legal case that found against the CMC with similar claims made. So, raise a complaint. They are now regulated by the FCA. So, you have access to the FOS if they reject.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0

If it hasn't got to the submission stage yet you could reply to them that you wish to make a complain and give the reasons. THey are required to act on your complaint. If they submitted the court papers during this period, you could request that the court puts a stay on it pending the outcome of the complaint or throw the court case out due to them giving insufficient opportunity to resolve using a free-of-charge regulated independent arbiter.
Hopefully, one of the other regulars here will give you a link to the thread that showed the successful court case.
