What you are describing is the template defence, not bargepole's concise older one. So you have the right one which is good.Should I leave this paragraph in as written?The template comments there already say ''DO NOT USE THIS'' unless it is true.

Which it is not, in your case. You DO have knowledge of the PCN and YOU were the driver and there's no reason to pretend otherwise, in your case by talking about other possible drivers.I rang their general enquiry number to try and pay by mistake. They told me if I could prove I’d rung that number I’d be let off any charge.They lied; this is b@ll@cks from them. You could mention it as your para 16 though and admit to driving and say what happened. But not using ''I'' or ''me'' of course, as you've seen the defence is written in the third person, so yours would be along the lines: 'The Defendant was the driver and the Defendant tried to use all avilable methods to pay...blah blah...what happened was...blah blah...and the Claimant already knows this because the Defendant appealed and this was refused outright, despite the failure being with the Claimant's system..''.
