County court claim form

Received a Claim Form from the county court business centre. Don’t quite understand the significance of this for, ie. how far away from actually being taken to court it is. They are asking for £235 for an original £60/100 fine.
The background is for non payment of an Excel car park on 19/10/17. I tried to pay by phone over what I thought was the correct number, it wasn’t they said I would be let off if I could prove I’d rung them at all. My phone company doesn't issue bills, so I couldn’t do this and didn’t appeal. Do you think I have a case worth pursuing and if so any tips on what to put in my defence?

What is the Issue Date on your County Court Claim Form?

As both the replies you received on your earlier thread... you need to be reading the second post on the NEWBIES thread which has all the information you need at this stage.

It is not a fine, it is an invoice from an ex clamper and they are acting unlawfully, read this

and report the cheating law firm to the SRA

Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

If you defend it , assume 6 to 12 months before you can speak to the judge in civil court near you

What is the issue date on the claim form ?

There's going to be a massive backlog of cases once the court system gets going again, so it's not going to be any time soon.

Possibly over a year, eviction cases will take priority.

The issue date is 3 March
With a Claim Issue Date of 3rd March, you had until Monday 23rd March to file an Acknowledgment of Service.
I am going to assume you have filed an AoS by that date. Please confirm.

Having filed an AoS in a timely manner, you have until 4pm on Monday 6th April 2020 to file your Defence.
That's under a week away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

Guidance on creating a Defence is also in that thread - in the first post on that thread.
Don't miss the deadline for filing a Defence.
