    Below is the exact wording they used in their appeal rejection letter. It is not very wordy. Does this mean they have followed the POFA rules, and does this mean they can transfer liability to me as the keeper?

    The rejection letter has nothing to do with it. 

    That isn't what I asked about and I told you what to compare with what, right down to the paragraph number of the law to look at.

  • Thanks - sorry I didn't read your message properly.
    The NTK (attached below) does talk about schedule 4 of POFA. They refer to a 29 day period in their NTK, but the POFA refers to "28 days beginning with the day after that on which the notice is given". Is this an error I can highlight in the POPLA appeal or not?

    That's not POFA compliant but you can see that yourself, from the Act and paragraph I pointed you to.  It is really easy to do, please don't ask us to do it. 

     So much better that YOU understand the problem & can explain it to POPLA.

    The paragraph on that NTK above the one about 29 days, also fails to tell the recipient to 'pass the notice to them' which I am hoping you've just read in the POFA is also required wording under either para 8 (if there was a windscreen PCN first) OR para 9 (if not).

    POPLA are not great on POFA.  You have to quote the Act and quote the NTK and point out the omissions.  Anyone can do it, this is like 'spot the difference'.

    "given" means you have to have received it
    its assumed to take 2 working days for post to arrive. 
    You can see hwo 29 days - presumably from teh date of printing, which may not be when they post it! - cannot ever, EVER, be equal to 28 days plus 2 working days for the notice to get to you.

    The card processing charge is probabky illegal, why not ask your local Trading Standards Department, the scammer may be required to replace all their signs,  
    You never know how far you can go until you go too far.

    Hi again
    Just an update.
    So I submitted the POPLA appeal, and after a long wait, I have been told today that Private Parking Solutions have uploaded evidence and that I have 7 days to respond to their comments and evidence.
    Is it normal to be asked to respond to evidence? Does it mean that POPLA are not taking my appeal seriously? 
    In their appeal they are going on about the fact I was parked in the disabled bay without a badge, that I am the keeper - POFA 2012 blah blah...
    In my reply comments, do I just repeat the same points that were in my appeal letter, word for word?
    i.e. for the POFA 2012 comment they made about me being the keeper and they can pursue me, I had originally appealed it on the basis that their wording was all incorrect, and the timescales were wrong. 
    Do I simply repeat the points I originally made? Or are they looking for new content?
    Thanks for your help.

    It is perfectly normal to have to counter the "evidence" that the parking company has put forward.  Do not just repeat your POPLA points, you need to take every point you made, look at the PPC's response and either accept it or argue it.  If the PPC did not produce evidence against any of your arguments you say that they have accepted it, therefore you win the appeal.  The PPC has to win on all points, you only have to win on one!
