    They can provide the service, you not being able to get there is not there fault. If you paid for your flights with a CC then you may be able to use S75 for a consequential loss. Booking.com may put a spanner in that works though as it may be seen as a third party.

    Bottom line is you have insurance, use it.

    Have you asked them to reconsider ?
    Asked for a reason why you wont get a refund ?

    I did ask but they said because I didnt take the cancellation insurance they would have to charge and couldn't refund. They then refer to the policy. I'd have no issue if I actually cancelled but I was looking forward to it. No way I was not going, sadly I didnt foresee this pandemic 😂

    They cant provide the service because I cant travel to them under government instruction as it's a health risk to me and them. They should not be open or taking customers because the city is locked down no? Is that not profiteering, I wonder if they have a full compliment of staff? Are all the services available? Have they lost out because I cancelled and someone else would have purchased the room? 
    I have the insurance yes but I dont want to use it because I dont see it as my fault. Why am I having to be out of pocket for something out of my hands?

  • Has the hotel cancelled your booking or have you in effect cancelled (or no-showed) because you can't get there?  If the hotel has cancelled I'd expect them to refund you (or whatever their T&Cs and Dutch law say).
    If they haven't cancelled and you simply can't get there, then it's nobody's fault and that is what your travel insurance is for.

    Has the hotel cancelled your booking or have you in effect cancelled (or no-showed) because you can't get there?  If the hotel has cancelled I'd expect them to refund you (or whatever their T&Cs and Dutch law say).
    If they haven't cancelled and you simply can't get there, then it's nobody's fault and that is what your travel insurance is for.
    That's it they havent cancelled however I cant get there. But is it not a duty of care to cancel? I would strongly argue I havent put them out of pocket and i didnt cancel. This is going to be a running theme for quite afew people.

    Sounds more like it's you who can't deliver yourself to the service! If they were actually closed you'd have a point.

    Well not exactly. I was able to go my flight was cancelled. Is it not irresponsible to remain open when nobody can make the trip! Consumer rights?
