    Was dreading it was because it was a leap year and 27th Issue date , literally come off the phone with MCOL and they advised...."not to worry all fine today last day, ok emails to address will be picked up tomorrow I sent mine at 10:32, she advised because of AoS but can't see that as one could have sent previously".
    thanks Keith P too, think message is definitely do a few days before so no in hand. I'll be honest struggled with lockdown and 4 young kids in the house.
    i understand they send defence tonight to claimant.

  • Hi All,
    So today I received the Notice of Proposed Allocation to the Small Claims Track dated 2nd April.
    It states that 1) This is now a defended claim, the defendant has filed a defence. 
    The DQ needs to be completed by the 20th April. As mentioned because I am not far from Warwick was proposing to list this as the Hearing Venue rather than Solihull where I live.

    Yes go for it, and hope DJ Joseph strikes it out.  Attach a copy of the Approved Judgment from Southampton (6 pages - the one that was your appendix C) to the email attaching the DQ and ask that Warwick Court follow suit, given this is yet another inflated parking claim and the court and honest, family-orientated, busy people like yourself, need to be spared unnecessary hearings by greedy parking firms right now.

    I know you've already sent appendix C. I am saying attach it again...and put some words in the email!

    Back to a previous question "In addition in DQ D3 would I put 2 witnesses (myself and the colleague regarding the lack of a survey / questionnaire re point 18: Landlord and Tenant Act 1987 Section 37 (5). ..... Also are they only expected to provide a Witness Statement and not attend court?"

    They only ask about the number of witnesses to make sure the room is big enough to accommodate you all.  Witness statements carry more force if the WS writer is there to be questioned by the claimant, otherwise the claimant can claim hearsay.
  • Thanks so you could 1 (myself) and then have a witness statement from the colleague on other point. What happens if put 2 (include them) and they can't attend in person?

    You are overthinking this , it's about the size of room they may need , put 50 and they would need a large room or courtroom

    Put down 3 or 4 if you like , the actual number could be the same , or less , but should not be more , you won't be tested on it on the day , so put down the maximum that it may be , doesn't matter if less are there , but would matter if 50 turn up

    Just to update I received Notice of Transfer of Proceedings, advising claim transferred to Warwick County Court where a procedural judge will allocate the claim to track and give case management directions.
