    Also dont worry - youre never paying their solicitor costs. the court would have to decide your behaviour was unreasonable. 
  • Hi nosferatu1001, that was a major concern of mine, as I know in 1st claim no solicitor fees added, however the 2nd claim DCB Legal costs of £50 had been added, but that was part of claim. I assume not settling prior going to trial not deemed unreasonable then?

    I would have thought as there are 2 claims in motion DCB would deal with the 1st claim too in light of the Cause of Action Estoppel?

    They will plough on with both until the court stops them or they lose at a hearing.

    Good Evening 
    So regarding my email to the County Court pertaining to Cause of Action Estoppel on second claim, I received attached letter today. 
    ...Upon considering an email from the defendant and the Court file a District judge has made the following comments:-
    "If one or both parties wish to consolidate this claim (first claim ref) with (second claim ref), then they should invite the County Court Money Claims Centre to transfer the file to Warwick so that this can be considered in advance of the trial of this claim on 26th August."
     Regarding second claim I received a letter last week dated 6th July acknowledging receipt of my filed defence.....the claimant will inform the court that he wishes to proceed (if dispute cannot be resolved informally). The court will then inform you of what will happen. 
    Basically not received DQ yet so based on CoAE letter received today propose to email the CCBC and to transfer file to Warwick. Wonder if I should complete DQ and send that too?

    So do that - ask the CCMCC to do so. 
    No reason not to complete the N180. You have to do it anyway so you may as well.

    Good Evening 
    So emailed CCMCC and asked for consolidation and included DQ.
    Interestingly received DQ from DCBLegal today advising "Having reviewed the content of your defence, we are writing to inform you that our client intends to proceed with the claim"..In anticipation of court directing to file DQ's they sent theirs.
    I sent my DQ this morning and advised of the request to consolidate claims to CCMCC (not knowing they sent theirs)
    For first claim where Excel did not appoint Solicitor, I did not receive DQ assume I should flag this in my WS?

  • Good Evening please find attached WS intend to submit this Wed 29th July, as I have been ordered to send WS and documents to Court and each other no later than 28 days before the final hearing (26th August). I acknowledge very last minute but any comments appreciated. I will be finalised Cost Assessment tomorrow.
