  • OP - it's a moot point  if you've already paid it, but out of curiosity I might be interested to know what address is on the V5?  Is it your wife's address or is it a Motability address?  (ie the first NIP may have been in your wife's name and the address on the V5, but what is that address?).

    I know the V5 address just needs to be one you can be contacted at, but if I were the RK I'd be a bit wary about not physically having possession of the V5 and having a third party's address on it precisely becaus eof what's happened here.

    It's not really too difficult to understand.
    Motability are the legal owners of the vehicle and the OP's wife is the registered keeper.
    As the RK, the OP's wife will have her details on the V5C, hence her details will be accessible to both the DVLA and the police.
    As Motability are the legal owners, then although it is the wife's details on the V5C, they are perfectly entitled to keep hold of this document as it relates to property that belongs to them.

    I think the question being asked is ... how do Motability have it in the first place if the OP's wife's name and address are on it?

    Correct. And it's a rhetorical question, as I'm 99% sure this has come up before, probably on this forum.
    Motability register the car in the lessee's name, but use their own address. This is precisely because they want to have the V5C in their possession, as do most leasing companies. It also means that they can tax the car, which is part of the deal.

    The V5(c) may well be in the OP's wife's name, but at what address.  This is crucial as that is the address everything gets sent to.  If the SCP/Police send it to the address as given on the V5(c) as these are details held by DVLA, and it arrives at that address within 14 days, then everything is in order.  Simple as that.

    The police claim to have sent it to our address the day after the offence. It was never received but proving that is almost impossible.

    Which is why you need to get a copy of the V5C to make sure that the DVLA have the correct address. As above, it may well be that your wife is the RK but the fact you haven't got the log book suggests the address is that of Motability and until that changes you're never going to get the initial correspondence relating to speeding fines, parking offences etc.

    Did they read back your address or simply say that they 'sent it to the address that DVLA have on file'.

    So the V5C says...
    "Mrs B02
    Motability House
    Motability Road
    Motabilityville
    MO1 2TA"

    The police have sent the s172 to that name and address. THAT is the 14 day time limit.
    And then somebody at Motability sent it back to the police saying "Mrs B02, 14 Anywhere St".
    The police re-sent it. That's what didn't arrive.
    But the follow-up did.

    There is no out-of-time here. But, even if there was, Mrs B accepted it and confirmed she was driver, and it's all moved on past that stage.
