County Court Business Centre query

My girlfriend received a PCN back in Dec 2018. She was not the driver (I was) and she passed it on to me to deal with. Alas, I didn't as the original evidence provided by One Parking Solutions looked weak to me.

My gf passed on follow up letters that I ignored and now she has just received a County Court Business Centre Claim form including Claim no.

A few questions:

Is this likely to be legit?
If it is, can I get anyway with paying the original fine (£100) - Claimant is now asking for over £250.

I'd like to resolve this soon so any advice would be very much appreciated and get my gf off my back (she is non too happy at the moment).

(See attachments for letters)
Thanks,
David

yes its a legit court claim

no , she must defend it , its in her name , its nothing to do with you, but you can assist her

there will be no "soon" at all, this will go on for several months

get her to email a SAR to the DPO at OPS asap, attaching a copy of the claim form as proof of I D under GDPR

nb:- ISSUE DATE is 17 march 2020

Cant we just pay up the full 250? - surely that will wrap things up quickly?

WILL PAYING THE SCAMMER THE FULL TOTAL WOULD CERTAINLY DO THE TRICK, but we would not recommend it, because it would be lower if she lost in court , £200 or less, plus she may win in court and pay nothing

take those pictures down, they show too many personal details and references

you could offer OPS £100 , they will refuse to accept it , especially now they have paid out for an MCOL claim

That's a lot to read. I'll have a sift through. Looks like I shouldn't have posted in the first place as likely to be an answer already - my apologies!

no problem in you posting , just ensure you understand the basics first

if she wishes to fight this , people here will help her , a typical loss in court is £200 or less , the added fees are against the CRA 2015 etc , known on here as an abuse of process

Most answers are in the sticky, but you are likely to need guidance around it. No need to apologise, but there's no easy 'out' other than paying the full amount now on the claim form.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
