Help please - refund for holiday

Hello

never posted before and need some advice.

we have had our ski holiday cancelled recently (along with thousands of other no doubt), I’ve tried to claim a refund but the hotel is saying that they will provide a voucher to use within 12 months.
we cannot go next year a) due to GCSEs and b) huge uncertainty that we couldn’t travel anyway.
they state that this ”In this context, the Secretary of State to the Minister of Europe and Foreign Affairs in charge of tourism, Mr. Jean-Baptiste Lemoyne, announced on March 17, 2020 a vast plan of support for the tourism industry. This plan provides for vouchers to be used for a future stay for all vacationers whose stays had to be canceled as part of the measures taken to stem the coronavirus epidemic.
This provision complements the tourism code and covers the specific case of stays affected by the restrictions targeting places that welcome the public.”

Any advice on trying to get a refund?
Ckearly I don’t want to pressure the system, but I feel I am entitled to a refund?

Any help welcome

There is a corona sub forum for these posts. Will move it there

Was this booked direct with the hotel or via an agency or tour operator?
From a hotelier's point of view I guess there is probably no money in the pot to refund everyone immediately and what cash is available they will likely what to hold on to for reserves to see them through a very difficult time.  Difficult times.
  • hi, booked it direct via Booking.com.
Totally appreciate it’s difficult for businesses, but also difficult for individual families who have saved for a holiday. I’ve written politely to them explain we cannot rebook within the 12months.
if it’s still a no, is the order insurance then credit card or the other way round?

Booking.com are going to be difficult to reach at the moment but I think you need to contact them and make sure they are aware that the hotel is actually closing (rather that you just deciding you don’t wish to travel). On that basis I think a refund should be given and it is reasonable that you push for that outcome if it suits you. It may take them a while to unravel as they contact the hotelier.

If that fails, I would approach your credit card company. Document your calls/steps being taken so you can show your credit card company what actions you took to resolve before asking them to possibly start a S75 claim.
