    If your money is deposited with solicitor but not exchanged yet, are those funds protected ?

    they have been exchanged when contract exchanged last month

    Are you sure you've exchanged? Why are people still waiting on any documents?

    Could you have just 'signed' and not exchanged? Completion dates are fixed when you exchange. They cannot (usually) change.

  • I’d be really shocked if the exchange had already happened and they don’t have a full mortgage offer in place (which it sounds like they don’t if the lender is asking for more docs). If you have exchanged then I’d be breathing down your solicitors neck to serve notice and find out what the heck is going on. Exchange is legally binding, you’re within your rights to claim any and all costs incurred by delayed completion and to force it if necessary. However as I said, I’d be surprised to hear contracts have been exchanged without their finances in place. 
  • Ps you can still move, despite lockdown. People who have already exchanged may carry on, however make sure you discuss fully with your removals team what is happening and if they’re still going ahead, or the van hire company etc.

    i may double check cause did sign with the closing date been today the 24th but we got email the 13th asking could the 18th work which we said yes but that didn't happen as delay and then they asked the 20th but nope once again didn't work.
    The seller is saying the bank are asking for more docs to drawdown.
    But by the sounds of it he didnt have everything in order before signing.SameOldRoundabout said:

    yes that u say it we were unable to sign the contract with the letter from the bank to show we were approved first. The only docs we had to submit after was home insurance and life insurance
    Going to get onto the solicitor now and see what the story is 
  • Are you sure they signed the contract?

    You signing it is academic, your solicitor can change the date and other details after you have signed (as long as you agree), as long as you haven't both signed. And the contract is obviously not valid or binding until all parties have signed.
