CCJ Rewnewal after 6 years ??

Options
Hi all,
Hoping someone can shed a little light here, as just had a weird phonecall from "the courts, or a county court" to say someone is seeking a CCJ against me.....
Specifically, a firm that buys debts from other firms...
History:
I had a CCJ placed against me in Nov 2011 for £266.  It was done at a property i had moved out from a long time before, unbeknown to me at the time, the £100 BHS store card i had, it was used to its limit (£100), not by me.  However, the only time i new about the issue and the CCJ that was placed against me was when i did a credit file view in 2014 and saw the CCJ..  Paid £10 back then to the northampton county court to get the info, but didnt do anything with it.
The CCJ dissappeared from my credit report in Nov 2017....

I just took a call from a girl who said she was from weston super mare county court, to say a debt firm has purchased this debt from Santander, and that they are seeking ballif action, or another CCJ.....
How does that work ? Its been over 8 years since the original CCJ was put against me, so although its gone from my credit report, does it mean a firm can buy the debt for like £1 (for instance), then re-apply a CCJ against me again for same debt, then get court appointed ballifs to knock on my door ?   Bit confused here.....

They can't get another CCJ, but the debt remains enforceable, although they may need to justify any lack of collection activity.

I think they will struggle to convince a judge that enforcement of a £266 debt is justified after 8 years of doing nothing.

ok, so they cant make the CCJ re-appear for another 6 years, ok, understood, cheers :)
So just trying to read a bit more on google, seeing things like statue barred, which i understand doesnt apply here.... (with CCJ)..
What about the Ballif thing ? (am thinking of those guys from the TV, cant pay we take it away!)
So after a CCJ has gone from your credit report, and you have had no contact for over 8 years, is it a case of, these firms that buy CCJ debts, can make an application to any county court, and apply for a warrant as such to instruct ballifs to come and get there way into my house to get some cash or goods ?
Ie:  The CCJ debt remains legally enforce-able ?
The lady who called me , called from a number for the north somerset county court (warrant control team ? )

  • Hi wondering if anyone can help, had PPI reclaim 2011 was totally unaware of the tax I’d paid until I seen it on martins show I’ve phoned the tax office they said I have to put it in writing but highly unlikely I will get it back how is this right??? We were scammed years ago on PPIs and now again on tax any help would be great 👍🏻

Bailiffs are a long way off so don't worry about that. Before any enforcement action can be taken they must apply to the court and essentially get permission from the judge, they must show a good reason why enforcement action should be allowed after doing nothing for 8 years.

Are you sure you had a a call from the County Court? Sounds more like the debt collection agency.

I'm afraid this falls under the category of 'things which aren't scams'.

You should have applied for the tax refund at the time, not nine years later. You won't get anywhere with it now.

You should also have posted on the PPI boards, rather than on someone else's CCJ thread.

    cheers jimbo :)
not worried at present, and the call was defo from the county court (weston)....
Heres my gut feeling:     Someone has leaked my info, say from the tax office (has my salary and direct dial works number which is not advertised anywhere, apart from on Gov websites)....
So debt place gets my data, then decides to chase a £266 debt by applying for a warrant of control (i think) from the county court, for a debt (CCJ) which was issue in 2011 .......

I am stuck with reading conflicting info, ..  this link says i should be OK given the time:

I also read that the creditor cant obtain a warrant of control for a debt below £600 (has to be between £600 & £5000 )
    Stuck !

I suggest you contact National Debtline who should be able to give a definitive answer and discuss your particular case.  https://www.nationaldebtline.org

I did.....  used the online chat, got a lot of copy/paste comments come my way.....
The only thing the guy told me was that if you have a CCJ, you can chased forever with fee's added each time...
Which doesnt sound right....    I havent been chased yet anyway, so worst case scenario, i would just pay the £266 to make them go away...   i am just more curious now how it all works :)
