    Hello,

So, I've send my defence to the court (all was OK) at 3rd of March.
I've received the DQ questionnaire, BUT the claimant hasn't filed the defence at all.
Isn't that invalid for the court process?
I remember that the claimant has to do something within 28 days after I file the defence.
Can I request from the court for the case to be stroke out?

    1. Is this your thread?
    2.  If not, start your own with a load more details
    3.  If it is your thread - apologies
    3.  Claimants do not file a defence
    4.  The claimant responds to your defence when it is sent to them by CCBC.  They have 28 days to do this BUT you don't know when/if the defence has been sent

    This is my thread, yes.
    1) Le_Kirk, if they don't respond to the defence, can the case proceed?
    2) Can I ask from the court to let me know if the have responded to my defence?
    3) And, I haven't  claimed compensation from the claimant.
In which document and when should I do that?

Nope, it's vol69's thread. Are you vol69 and maybe you've changed your user name?

Is your case related to Civil Enforcement Ltd and being ticketed at a surgery?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No it is NOT your thread. Yours has a similar but not identical title but this is not it. Please delete your posts on this thread and post them on your own which I suggest you then bookmark/put in favourites.

    Your thread is here.

If you have a DQ then by definition they're cont8nuing the claim.
You cannot claim "compensation". You can claim costs, and there isn't a form. You create a summary costs assessment and hope the judge grants it. Same as any case

Isn't it strange at all that I submitted my defense at start of March and I've received a DQ in start of May?
And shouldn't the claimant file my (defendant's) defence?

    Thanks nosferatu1001. ;)
