Any comments by the judge about double recovery is not binding in any future cases , has to be a higher court , hence the excel Vs Wilkinson case is better for that premise

Well done on your win against Espel

Another one bites the dust !!  😁

Nice result, well done. No hearing, no advocate, no legal costs for ESPEL to have to splash. A free shot at gaining £200.  But another 90% punters will have paid on receipt of the court claim. The overall business model continues to be extremely profitable.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hello, but what grounds would I be making a claim against them?
What tangible loss have I incurred?
Surely this will only result in wasted costs for me of the issue fee and then a potential wasted costs order against me and even an abuse of process for bringing a vexatious claim?

I wouldn't lie awake at night awaiting a reply to your specific questions!  Everyone gets one of these.  I've yet to see anyone report progressing the advice.

That surely is a matter for you to decide having done your research

I don not come here to spoon feed people.who cannot be @rsed to use a search engine , read the newbies, or guidance notes.  I tell them where they can find information,  which may or may not apply in their particular circumstances.  In other words,  I help people to help themselves.

Yes, but those less informed may misconstrue your comment as advice that they should commence proceedings against the parking agency which is simply not entirely a good idea in most scenarios.
The only time prudent to do so would be on the basis of wasted legal costs, at which point the legal representative would be able to provide the relevant advice of pursuing a claim to recover costs.
I only comment as I hate to see court time wasted.
