Apologies, realised I changed terms halfway through my post. The application was to strike off the claim. I didn't know to ask who applied for it I'm afraid - presumably from the court if 'neither party attended'? I should have paperwork through in a few days.

I think the word application is wrong, I suspect the clerk should have said an Order has come through from the Judge.

If you didn't know about the hearing then I suspect the other side may not have done, either, so expect them to complain and for a new hearing to be set...this is unlikely to be over.

Thanks @Coupon-mad. It's a bit odd, as I knew about the hearing, had sent my contact number to the correct address and waited for the call as per the instructions (which I've read about 20 times) - but no call came through despite chasing via email. And the order is claiming that neither party attended.

It sounds like a court error and I reckon the C will be all over it and get it relisted.

True, mind you, if the judge was sitting on his hands waiting too, that's already cost time and resource.

C is a corporate and professionally represented, if they failed to organise the call (the order for the hearing should say who is responsible) then its legit to say no second chances. My experience is that telephone providers rarely mess it up

I agree court has struck from its own volition in all likelihood.

    Order from the court today:
"upon neither party attending. And upon the claimant failed to provide the court with a contact telephone number in breach of the court's order relisting this hearing. And upon the claimant has failed to comply with the court's direction order. It is ordered that the claim struck out." Dated from the day of the telephone hearing.

As I said, an order from the Judge, not an 'application'.  Well done!

It is over unless the Claimant objects to that Order in the time it allows them, if for example they can prove they DID supply their phone number and did comply with the previous Orders.
