Hi all - Hearing is finally happening this morning...

...SP requested an adjournment after reading my skeleton. I was happy to accept. The judge also wasn't happy with it just being a phone conference and wanted video instead.
As this is you suing Smart Parking, the popcorn is out!  Why did they need an adjournment to read a skelly they've had a while?

TBH, I'm happy to adjourn just to get a video conference so I can see the look on the Director's face when he loses.

It also gives them time to consider and come to a reasonable settlement instead. If the judge rules in favour of me on a few of the points I raised then it would invalidate every single ticket ever issued on that site.

Postponed again till next year with a longer time allocated.

A JP friend of mine commented that he thought judges were passing on it because my skeleton was so comprehensive they'd have to really think hard before passing judgement as it had the potential to undermine every ticket ever issued at that site.

Brilliant.  More popcorn is needed, especially after the DLUHC come up with their analysis and draft Impact Assessment this month.

    Do stick around, @pould

I reckon Smart will make you an offer or two.  Someone last month did a counterclaim and got £650 from a PPC - can anyone recall who? I meant to make a note of it.

    @devondiver's daughter.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Hello everyone,
We had court requested mediation in this case today.
Smart Parking made no response to the key issues I raised with the mediator and made no offer of settlement. Quite frankly, I think the mediator was more frustrated than I was as this was clearly against the terms of mediation (you need to agree to come to make a settlement).
We move to court. If anyone wants to see my skeleton, let me know.

Received confirmation the claim has been delivered. Smart Parking have till 4pm on the 20th to acknowledge. Feels marvellous.
We've been working on my statement over the weekend. We have a large pile of the proverbial to dump on them the moment they acknowledge defence.
Wow - you filed this claim in May 2020!

One hearing before a Judge - adjourned in 2022 - then the court kicking the can down the road endlessly since then.
