    They have not sent me a letter stating the feel of £90, apart from this one. I have had no letter stating that it will be sent to elms legal by excel.

    I cannot pay the claimant as I have already said they are refusing to accept payment, they just refer me to ELMS
  • Ive told you to pay the person named on the CLAIM FORM. Not to pay the claimant. They are not always the same thing. 
    They cannot refuse payment. You have a judgement to pay, they have to accept payment. Send a cheque. Do SOMETHING but dont ponder too long. 
    If you have not had the letters they stated were sent, then complaint to the SRA is in order. 
  • The company on the claim form is excel and it is them that I have contacted to make payment and it is them that is refusing.

    If I pay ELMS legal and make it clear it's under duress would I have grounds to submit a claim against excel?

    Send them a cheque then, make reference to the judgement and include a copy of the order, to show you have paid in full.  Once it is cashed, get a copy and send it to the court so you can show you paid the court order in full
    When you wrote to Excel what did they state? Unusually the order had no time limit on it - just "forthwith". 
    No, you would not.

    I did not write to excel, I called them and they stated "speak to ELMS". I do not have time to go back and forth with letters as the deadline to get the ccj removed from records is in 2 weeks. I requested to pay them directly and they refused to provide me with payment details.

    I do not have cheque book, and even if I did, what if they do not cash the cheque or cash it after the 30 day limit which would mean the ccj stays on for 6 years?

    @BrownTrout not sure why you say it's nonsense, what is nonsense about it? I want to pay within a month of judgement date so that it gets removed. If the only way to do that is by paying the ELMS fee then yes that is under duress

    Because people are daft, timid, ignorant, gullible, naive,  trusting, whatever.  Several years as an Immigration Officer in  Nigeria and Bangladesh lead me to not believe anyone

    Record the call to Excel. 
    State in it you are recording it
    Get them to admit to REFUSING payment on the call. State you wish to pay the judgement amount of £155 as per the order of... with ref.... and, as Excel are the claiamnt, you are paying them. You have no Order to pay anyone eklse. State that, should they refuse payment, you will lodge this recording with the court and Apply, formally, for them to be sanctioned by te court. They may not refuse payment, nor may their agent "Elms" add additional costs when you have not broken the deadline for payment.

    As you can see, you may be in a position to cause them considerable indigestion.  Use it, be robust, kick @rse.
