I would have said that unless you want to risk the court not having your defence - a crazy risk to take - inclouding it would be obvious. 
The need for the bbundle is the Judge doenst have access to the papers.

I've heard nothing back from Gladstone's regarding the preparation of the bundle for the telephone hearing, despite sending them numerous emails. I can't get through to them on the telephone. Any suggestions as to what I should do if I don't hear back from them as the bundle needs to be with the court next week.

Make sure yours is submitted to the court in time and inform them of these failings by the claimant and their legal team contractor

Submit a single PDF of your defence, WS, exhibits, and I would also include at the end, in an appendix, proof that you tried to arrange this with the C as per order from judge x of date y - email printouts etc. STate that in the absence of any cooperation from the claimants representatives, as required in the order, you feel you have no choice but to at least file your bundle directly with the court.

The Government is consulting for just a few more days, about a new statutory code of practice (CoP) and framework intended to rein in the rogue parking firms. 

Does it go far enough?  Read and comment on the draft CoP proposal and the enforcement framework consultation (two separate consultation documents).

HOW TO DO THE SUBMISSIONS:

BSI PAS 232 – COMMENTING ON THE CODE OF PRACTICE AS DRAFTED :

1.    You will need to register then log in, to comment on the CoP and enter an occupation even if you are retired or a homemaker.  

 

2.    Register, log into the BSI page, and download & read the cover letter here:

3.    Read the cover letter again and note the suggested extra questions... if you agree that, say, the 'loading/unloading and dropping off, asking for directions, and disabled people parking on double yellows as they can on street' activities listed should be exempt (not parking events, what do you think?) then please go to the Annexes at the end of the PAS Code and find the one about Exempt Vehicles and state what other activity you think should be added to the exempt list. 

 

4.    Download the PAS itself and start commenting on what you wish to say something about.  Quick links to each section appear on the left of your page. 

 

You don’t have to comment on everything, e.g. you might want to skip the definitions and focus on later sections, and certainly look at the Annex tables at the end that show things like consideration & grace periods and exemptions.

 

5.    Submit comments when you are happy with them. Don’t just ‘SAVE’ and forget!

A quick update for you all following the telephone hearing. You'll be pleased to hear the claim was successfully defended. The Judge dismissed the claim on the grounds of unclear lines and confusing signage.  J also agreed that the £160 charge was excessive but said he wouldn't have struck the claim out purely on that basis, saying that £100 would have been the maximum charge that he would have allowed.  I was commended on how comprehensive the Defence was but sadly wasn't awarded costs, saying something about it being just a county court case. I wasn't too worried about that but just pleased that the judgement went my way and I now have some more ammunition to take back to the MP regarding this particular parking spot (which is complained about on the local 'Nextdoor' website on an almost daily basis).
