  • Have you reviewed the likely template WS theyve given you against the threads its likely popped up in before? That bit you must do.
For example, is the contract valid? For the right place? In the right company names?
Yes I did search for threads where it may have come up before, but came up blank. I also tried to find out who the landowners are through the land registry but the address details only gave me the name of the owners of a nearby housing association. It's a relatively new retail centre. So I am unsure whether or not their contract is valid with the right company names etc
  • Who prepared the WS? If it is say Gladstones then it will be a template Will be. Not might. Will.

The WS only contains pictures of two, (undated), signs, one of which state a max stay of 30 minutes and the other says 2 hours. The 2 hour sign only has a BPA AOS roundel on it; whilst, there's no mention of either the BPA/IPC on the other.

UKCPM joined the IPC in October 2015 so the signs are at least 3 years out of date.
  • Yes Gladstones prepared the claimant's WS and thanks, Castle for the detail regarding their 'out of date' signs!

It's people like Castle who digs deep and finds the flaws.  The signage is a big flaw   .  Gladstones, being robo-claim bods just act very badly for their clients.  Gladstones incompetence is well known.
You may ask why the PPC uses Gladstones ..... the rest of the dodgly legals are the same.

UKCPM might well do better if they had the guts to do it themselves.  Very foolish company

Just one of the incompetent Gladstones cases

So you then search for Gladstones WS and you'll find that what you have is, as you've been told, a template....so yo know what to do.

If you search for the name of the person who signed the template WS you will easily find threads about that WS!

  • The person who signed the claimant's witness statement is Alexandra Morrison and yes her name has come up before. Does she work for Gladstones or UKCPM (as she claims is an employee of the company in the WS)?
TBH I had to submit my WS and other docs yesterday.
I delivered a paper copy to the courts as they requested that documents over a certain size should not be emailed.
I emailed a copy to Gladstones but should I send them a paper copy too (as they sent me a copy in the post and by email)?

Did she sign the Statement of Truth?  Then you have it.

You've done what almost everyone is doing during the pandemic. It's enough.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I have emailed Gladstones with the documents I wish to be included in the bundle for the telephone hearing. Does my Defence need to go in there too?
