A good lesson in how NOT to fight a PPC.

She lost. PPC awarded £3360. Her defence was primarily one of victimisation and distress (the courts don't deal with the heart!)

Because she was a car crash in defending herself - I would have found for the PPC!

    - Failed to produce company's contract or tenancy agreement with landlord allocating 2 spaces. (As we know, tenancy trump's signage!)

    - She didn't push that the PPC had failed to mitigate - just kept issuing 35 tickets despite a note from her company manager in the car window on day 1 saying to contact the manager of the company to do so in the event of any issues. (She produced the note at least!)

    - Just generally tried to play on the sympathy card.

GIGO. however, from what you have said  the camp one appears to have reached the wrong decision imo.

An IPC rogue trader actually went to Judge Rinder claiming £3,600 over 21 tickets = £171 per ticket.
The case was regarding a lady who had been given a parking space by the letting company she worked for and told a permit would be available soon, Despite the boss of the letting agency telling the parking company and despite a notice in the windscreen saying so, the attack begain and 35 tickets were issued.

Judge Rinder said the signs were OK, he said that the parking company had permission to issue tickets without any proof they could. Rinder brushed off the fact that a permit was due and should have been issued
Bottom line is that Rinder awarded the parking company the amount of 3,600.

JUDGE RINDER ERRED AND MADE A HUGE MISTAKE.  Rinder clearly has no clue about POFA2012 or the supreme court and he NEVER mentioned either POFA or the supreme court ruling.
It is my understanding that IN THE jUDGE RiNDER show, there is a court limit of £5000. ITV pay the winner of the case, bit like a game show.

ITV should be notified of this gross error because if Rinder is making such a critical mistake, what other errors is he making.  I for one am writing to ITV as such an error seen on television is dreadful.

As far as the parking companies are concerned, best not start "as seen on judge Rinder" rubbish, it will still be down to a real judge to decide about Abuse of Process

You would have found for the PPC .... REALLY ?  You mean you would not be interested in how the amounts were calculated .......  maybe their will be a vacancy soon for another Rinder type, you can apply ?

How binding is judge Rinder on the defendant?
    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"

Summed up far better than I, beamer, however not sure if they needed to invoke POFA12 as I get the feeling she fessed up to being driver from the off .... Although it wasn't specifically mentioned ..... Because, clueless all round!

As for whether PPC had permission to charge, PPC only had to state they had permission. She didn't question it, so they didn't have to prove it ..... She failed to refute anything the PPC claimed and for them to back it up with paperwork.

In that respect, Rinder was 100% correct. He can only go on what he is presented and that which is proven (or not refuted!)

I was screaming at the telly for her to produce her company's contract with the landlord, or to claim they'd failed to mitigate any losses but alas ......
It's on ITV Hub for those that missed it https://www.itv.com/hub/judge-rinder/2a3290a0719

It's a game show as such so doubt if it's binding, not where a real court is concerned

Bare in mind we know what we know. Rinder doesn't, the defendant didn't, the PPC probably did!

On the evidence presented in court, which is all that can be ruled on, Yes, I would have still ruled in favour of the PPC! She failed in all respects to even attempt to disprove what the PPC was saying was strictly the case.

I'm not saying it's the correct verdict had the case been defended as we would all on this forum do, however on what was presented ..... Well, what could Rinder do?!
