Claim form/CCJ from Phoenix Parking Solution and QDR Solicitors

Hi
I was wondering if anyone here can help.
I got a PCN from Phoenix Parking Solution for originally £60 and 14 days later £100, about 5 months ago. I ignored the first letters from Phoenix Parking Solution, and began to get more letters from ZZPS and later QDR Solicitors. At first it was all threats, until today, when i received a Claim Form from the County Court Business Centre in Northampton which is asking me to pay £235. Which is broken down by, £100 fine, £60 admin, £25 court fee and £50 legal representative cost.

The question i had is, when i now go on the Phoenix Parking Solution website to pay the fine, it is telling me to only pay £100. If i now pay the £100 fine via the website will this mean that i have settled the fine and therefore no CCJ will be issued or will it only be settled if i pay via QDR/Claim form for the full amount of £235?

I am looking to get a mortgage this year and i don't want to risk having a CCJ which will really jeopardise my credit profile. Hence i want to pay it before it goes onto my profile, and i wouldn't want to pay £100 and still get a CCJ.  Any advice will be very much appreciated
Many thanks

Forget the mortgage.  I hear this daily from people " I am looking to get a mortgage this year etc etc etc cant have a ccj etc etc " a claim form does not effect your mortgage!!!!
I often actually wonder if half the people who I hear mention a mortgage are getting one or just making up reasons to pay up......

What is the Issue Date on your County Court Claim Form?

You will not get a lasting County Court Judgment against you even if you lose.
If you were to be so unfortunate to lose the court case, just pay the amount the judge orders in the timescale stated and there will be no lasting CCJ.

Even if you lose the court case, the total amount payable is likely to be ~£200.

    But that's enough about losing...
  • thanks for the response, the issue date is 14/02/2020

With a Claim Issue Date of 14th February, you have until Wednesday 4th March to file an Acknowledgement of Service. If possible, do not file an AoS before 20th February, but otherwise there is nothing to be gained by delaying it. To file an AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread - https://forums.moneysavingexpert.com/discussion/4816822/newbies-private-parking-ticket-old-or-new-read-these-faqs-first-thankyou

About ten minutes work - no thinking required.

Having filed an AoS, you have until 4pm on Wednesday 18th March 2020 to file your Defence.

That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

When you are happy with the content, your Defence could be filed via email as suggested here:

    1. Print your Defence.
    2. Sign it and date it.
    3. Scan the signed document back in and save it as a pdf.
    4. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    5. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    6. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.

After filing your Defence, there is more to do...

    7. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire. Nothing of interest there. Just file it.
    8. Wait for your own Directions Questionnaire from the CCBC, or download one from the internet - https://www.gov.uk/government/publications/form-n180-directions-questionnaire-small-claims-track , and then complete it as described by bargepole in his 'what happens when' post linked from post #2 of the NEWBIES thread - https://forums.moneysavingexpert.com/discussion/4816822/newbies-private-parking-ticket-old-or-new-read-these-faqs-first-thankyou"]
    9. The completed DQ should be returned by email to the CCBC to the same address and in the same way as your Defence was filed earlier.
    10. Send a copy of your completed DQ to the Claimant - to their address on your Claim Form.

ZZPS and QDR, all part of the shamed Wright Hassall solicitors

£60 ADD-ON ........ Wright Hassalll clearly need to teach QDR the english language as they were spanked for this abuse of process
Wright Hassall and QDR already know it's a scam
QDR (Part of Wright Hassall solicitors) spanked in Warwick court
    for ABUSE OF PROCESS

It's abuse of process so go and get QDR spanked again

Your MCOL password is clearly visible on that image, as is your vehicle's registration mark.
    Not a good idea.

I also suspect the reference numbers in the 'address for documents' box will uniquely identify you, and goodness knows what information can be gleaned from that QR-code.
  • Thanks KeithP, i will submit the AoS on the 20th Feb, and will take it from there.
  • Just double checking is this the post that begins with?
SMALL CLAIM? START A THREAD PLEASE (UNLESS YOU ALREADY HAVE ONE ABOUT THE SAME PCN) BUT PLEASE ONLY AFTER READING THIS AND DOING THE ACKNOWLEDGEMENT OF SERVICE ('AOS') FIRST.

    That's right.

Unfortunately the recent forum software upgrade has managed to lose the post numbers, but yes, the second post on that thread.
