Esa support group to UC, asking me to fill in UC50?

Options
Hi i applied for UC in Dec, been sending fit notes for 2 months. I have got the LCWRA added in my payment at the moment abecause im sending the fit notes i guess, but they told me they are sending me a UC50 to fill in. I thought ESA support group transferred to UC without assessment , should I ring them and ask about it on Monday? I did write on my journal that I was in esa support group but seemed to turn a blind eye. My last esa assessment was 1 year ago and usually i get assessed every 2 years.

As you've already got the LCWRA element added to your claim then they have done that correctly. You don't need to send in any fit notes because you already have LCW. You can be reassessed anytime from 3 months,  as your last one for ESA was 1 year ago, then receiving the WCA form is correct and you'll need to fill it in and return it no later than the date stated.

It said in my UC account to supply another fit note so I supplied my 2nd one last week , then they told me they were sending me the uc50 form out
  • If you were in the Support Group for ESA and there's been no break between your ESA and UC claim then you should not have to fill in a UC50 or have an assessment and you should get LCWRA automatically. I assume you were not receiving a Severe Disability Premium under ESA.
The rule on ESA assessments carrying over to Universal Credit comes from regulation 19 of the Universal Credit (Transitional Protections) Regulations 2014

The LCWRA element is already being added to the claim.
  • I did quote legislation 19 in my journal too .
  • when i first applied and went to JC the lady told me i would need another fit note after my first one expired
  • all of my WCA have been paper based

As the LCWRA element is being added then to ask you for fit notes was not correct but they can still reassess you anytime from 3 months. This applies to all work capability assessments, for ESA and UC.

i guess i wil just have to fill it in and send it back then.  the LCWRA has been on my claim since it started yet my journal still asked me for another sick note!! When i asked them on my journal 'How long do i need to send fit notes for' they told me they are sending me UC50 out this week

It's likely that sending in the continuous fit notes has prompted the form to be sent to you but they can reassess you from 3 months.
