  • Herbie & BailiffChaser,

I have been in the bailiff industry for over 12 years and do know what I am talking about, whereas you two clearly are playing at being legal advisors.

ACEA & ESA guidelines are exactly that, GUIDELINES, not law.

All of those stories you have both posted represent o.oooo1% of the debtors visited every year in this country. Can you provide any stories of the single parents who have had their child support successfully collected from their ex spouse? I know of thousands.

Can you provide any stories of the criminals who have finally been caught and forced to pay their court fines?

Can you provide any stories of the persistent parking evaders that have been caught?

How can you give such an adamant opinion when clearly neither of you have spent a single day in a bailiffs office. You have no idea what bailiffs have to put up with on a day to day basis, no experience of running a contract or what is required by a bailiff company from its clients.

You have blinkers on if you think all bailiffs do all day is prey on the vulnerable and needy. Just because someone owes someone money, does not mean they are vulnerable or needy, they may have chosen not to pay.

Sending someone a letter or visiting them does not constitute intimidation or harrasment. If you do not write to them or visit them, how do you propose the debt be collected.

You are representing a very very small minority of people, and I think it is time for you to stop painting the picture that this is a nationwide problem. It only seems that way because the media only show the bad stories, never the good ones.

'The Media', as you put it, are actually 'glorifying' the antics of what are, undoubtedly, the worst elements of your 'profession?' SE.

The visits 'featured' on the recent TV programmes do, unfortunately, show 'bailiffs' acting in a pretty despicable manner and, whether intentionally or not, send out a message that this is 'what to expect' when visited by a 'bailiff'.

There have been many threads, on this and other forums, where 'bailiffs' have used illegal tactics to enter properties and have spoken to the people at the receiving end of their attentions as if they were something that the bailiff had just wiped off the bottom of his shoe.

I have always found Herbie's posts, on this subject, to be extremely well balanced, especially as she deals with exactly those cases that you point out - 'the bad stories'. Bailff-Chaser may be slightly less eloquent, but his posts are, generally, as a result of treatment by those people that inhabit the bottom rung of your 'profession?'.

I am, to be perfectly honest, more than a little concerned at your comment stating that ACEA & ESA Guidelines are not the Law. This would imply that it is perfectly okay not to respect those guidelines and, ultimately, for a 'bailiff' to behave exactly as he wishes.

I do not, nor I believe does anybody else on this forum, feel that there is no need for Bailiffs as a final step in the enforcement of the law.

However, I do believe that Bailiffs should be fully regulated and should treat their 'victims' with common courtesy and respect. Recent events, and media coverage, may, as you say, highlight the activities of a small minority of players in your 'profession?', but if only one 'bailff' were to behave in this fashion, that would be one too many.
I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Point taken, but doesnt that also show that the system works? (ie he successfully appealed)

But most people wouldn't be brave enough to appeal, they will just be scared by the fact that the bailiff has turned up and will just hand over the cash.
