noBailiffchaser is talking about the television programme that was shown on BBC1 this evening.
It is a programme that is an 8 part weekly programme that follows a bailiff company (JBW Enforcement) trying to enforce unpaid parking tickets on behalf of their client: City of Westminster.
There are so many inaccuracies in the programme that I am surprised it was able to aired but more surprised that the BBC are using taxpayers money to make this series.
I have not has enough time to look at the programme in details but the most glaring errors were as follows:
The young bailiff (Jason) did not show a copy of his bailiff certificate.
He did not appear to leave a copy of the Warrant of Execution.
He said: "I am from Northampton County Court"....which he IS NOT. This may well be misrepresentating his powers and impersonating a court official.
I will know more in the morning.
Thanks herbie . What is really getting people like us herbie, bailiffchaser etc is that not alot of people are taking notice of the incorrect action the bailiffs are taking on tv and also in real life.ONLY COPY WHAT I AM DOING IF YOU ARE 100% SURE AND YOU KNOW EXACTLY WHAT THE END RESULT MAY BE. Herbie,
You state the bailiff did not show his certificate. Was he asked to by the debtor?
You state he did not provide a warrant of execution. Was one requested by the debtor?
You state he said "I am from Northampton County Court" which you claim is misrepresenting his powers. JBW is contracted by this court to collect unpaid fines on their behalf, so strictly speaking he is working for the court. The debtor is more likely to know what the debt is for, if he said I am from JBW bailiffs, it would mean nothing to the debtor, surely it is irrelevant to the debtor which company he is from, he is still there to collect the arrears.0 -
I have to say that I do disagree with you.
You state that JBW is contracted by the court to collect outstanding fines. In fact if you read the wording on the Warrant of Execution it clearly say the following:
"You have failed to pay a penalty charge registered at the Traffic Enforcement Centre at Northampton County Court as ordered. The Court has given authority to the above named applicant( Local Authority) to issue this warrant to recover the sum due"
JBW (or any other company of bailiff's for that matter) are contracted to the Local Authority......not Northampton County Court.
The warrant also says:
"If your possession are seized, you will be left a Notice of Seizure of Goods and Inventory together with a copy of this warrant"
Without doubt clamping, immobilising or removing a vehicle is "seizing" goods....therefore being given a Notice of Seizure and a copy of the Warrant of Execution........is a legal requirement. Notice the wording "you will be left"......it does not say......"you must ask"
You say that it would mean nothing to the debtor if the bailiff said I am from JBW Enforcement....and yet the debtor would know what you meant if you said I am from Northampton County Court. This is nonsense. The bailiff nearly always introducing himself as: I am a bailiff from JBW Enforcement...... the penny drops.
If however he says I am from Northampton County Court.....this should mean a "county court bailiff" .....employed by the court to collect a consumer debt......very different indeed.0 -
yesI'm just glad that people are being made to pay for parking like I have to.
When in London, I pay crazy amounts to park legally & do not see why others (mostly with 4 x 4's or Jags) should get off scot free, same with the insurance dodgers, great programe.0 -
