police,cars and bailiffs did you watch this today ?

noThe programme is showing how many people have not paid but at the same time is not showing how many incorrect parking tickets have been issued and how many fake ones exist which the onwer has never recieved.
For a pcn to be valid it has to be either affixed to the vehicle or handed to the driver. However if the ticket is being written and the driver drives off then it is not valid. However some people think that once a ticket has started to be written you have to wait for it. Also if the pa or traffic warden is blocking your path then you can use that against them in a appeal.. How is a fine issued by a camera "Fixed" to the car? their still leagal.0 -
Who is going to want to watch a programme that delves in to the technicalities of Parking Ticket Issuing. That would be the most boring programme ever.
The public want to see persistent evaders being punished and bailiffs going about their work, not an hour long documentry on the number of incorrectly issued tickets per year, which by the way will probably be around 5% of the total amount issued, which isn't going to be that interesting.
People who refuse to pay make up 70% of the debtors on any bailiffs database. If you send out 1000 letters requesting payment for a debt, only 25% will respond.
If these people are unemployed or on disability, then that is unfortunate, but most people will get several reminders from any court or local authority before it gets to a bailiff.
The average bailiff can visit 30-50 properties a day and will only catch around 10% of those people at home.
The national average collection rate accross the UK is only 30%, so the money a bailiff company makes on that 30% has to pay for the work carried out on the other 70% of cases, thanks to all those debtors who refuse to answer the door and refuse to respond to their letters.
Herbie, the figures you are relating to in respect of "Persistent Evaders" relates only to those people who have more than one outstanding fine. A person who simply ingnores a parking fine is not a persistent evader, and there are huge numbers of these.0 -

noI appreciate & agree with the general points being made that balliffs can use underhand tactics and that not all parking tickets are fair (I can personally vouch for that!) but this programe seems to focus on people who have made a decision not to pay for legit parking and also not to pay any fines...interesting that most of the 'victims' have really expensive cars as well!

If you saw the last programme where they towed the red alfa romeo away. You would have heard the voice over saying the car was eventually released when the owner sucessfully apealed against his parking tickets. What does that tell you ? Point taken, but doesnt that also show that the system works? (ie he successfully appealed) No voice over for all the other cars either towed away or clamped.0 -

These fines are 'legal' because they are 'backed by photographic evidence'. However, in order to be legally accepted the 'cameras' and those responsible for them, have to undergo regular legal checks - in fact many 'camera' penalties have been successfully contested on the basis that these checks were either not, or incorrectly, carried out.
Any 'element of doubt' would go in favour of the assumed driver.
We don't seem to have this 'avenue of defence' when confronted by bailiffs - even though there are circumstances where 'bailiff action' can be questioned or contested these are seldom if ever pointed out by the bailiffs, whereas a 'fixed penalty notice', relating to an alleged motoring offence, clearly states the options available to a defendant, should he/she wish to 'contest' the charge, along with that person's right to see the evidence in question.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
