PCN with Bailiffs at previous address, but current tenant has RTS all correspondence

  • no one has said you do not have a  ticket from the parking co , what we are all trying to tell you id that  in law there has not been enough time for them to take you to court and instruct bailiffs 

    why not send the parking co a SAR ?

    The PPC have to take you to court, usually this takes 4-5 months, win their case, and wait at least a month before they enforce collection.  

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

  • umm , with a default , matter of 14 days no reply = auto default , but even taking 14 days (+ 28 to actually pay) the times do not add up ,

    OP A lot of people here think that you are barking up the wrong tree, please enlighten us.
    You never know how far you can go until you go too far.
  • if you get calender out it cant happen 
    lets call it 2nd week in september 
    + 29 days MINIMUM ro get details from DVLA 
    + another 28 days with threatagram
    + 28 days for letter before court
    + issue court letter
    + 14 days to reply back to court or default
    + 28 days to pay default
    +  letter 7 days from court bailifs

    we are now in march at least as those are the minimum days and in reality would take much longer . often at bailiff  stage 2 or  3 mths

    Sorry for my lack of understanding. Still trying to get my head around this. 

    I get the timelines dont match but I dont see why the current tenant would lie about there being bailiffs. It would be great if they kept the paperwork that was sent but since they havent kept it, I am simply having to take their word for it until any new items turn up at the address.

    If I send them a SAR though, don't I have to provide my current details such as my new address? Do I want to give that to them? Sorry again for my ignorance on this. I appreciate I sound quite dim and frustrating. 
  • well , you should have informed the parking co when you actually moved house , as you had an outstanding invoice with them 

    you will need to show ptoof of who you are , for example utiluty bill or "any V5" with numbeer obliterated , and also inform there DPA of new address 

    but if you are adamant that there id no ccj showing on ALL files plud the trust one , then you can be sure this id not private , and  will be for counsil tax or other matter 

    as I have stated previously , bailiffs work from your local court , paperwork is sent to them , so any active bailif action will be held by the local court closest to the old residence
