PCN with Bailiffs at previous address, but current tenant has RTS all correspondence

  • september 2019 . ticket on car + 56 days + threatagram + letter before court  (30 days)  + 14 days at court stage , leaves no time to instruct bailiffs 
    and to add to this , a further 28 days after default , in which you had not paid ccj 

    it would almost be impossible for all of this (inc bailiffs) in time span quoted 
    Yeah it is odd, especially considering that they should have my updated details after the 56 days as I sold that car and updated the V5C.

    What should I do now? Wait and see if they send me another letter at the old address and take it from there?

    Would I just simply phone up a local county court to my previous address and ask them why bailiffs attended the property and who they represent? Sorry for my ignorance, really not sure how to go about any of this.

    If bailiffs turned up they would have left paperwork. In fact, there would have been a letter 7 days prior as they do not attend without warning. 
    The answers you want are not here. They are at your old flat. And it is highly unlikely though not impossible it is for a single PCM ticket. 
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere

    But this is the issue. The tenant has returned all the paperwork back to the sender. There are no letters or anything at all because they just RTS them. Hence why I am not sure what I should do.

    I don't think PCM normally do court, but CPM do. Are you sure you have the right scammer?
    Even if this is the case, the timings still don't add up. The scammers could have got keeper details after 28 days, or could have left a "This is not a PCN" type ticket on the car and got keeper details by day 14, even though the DVLA have now allegedly stopped this practice, but it would still be hard to get to the bailiffs stage within the timescales you mention.

    As an aside, if you fear a visit from bailiffs then I suggest you contact Sheila at Bailliff Advice Online. She posts here as Herbie21 and has a good reputation on MSE. Make sure the home page has an open law book as there is another company with a similar name. She might be able to advise you about searching for a CCJ, or perhaps Legal Beagles might be able to help.

    The important thing at the moment is not to tip the scammers off to your new address. With regards to contacting the court, if it was uncontested it will probably have been done at the scammers local court rather than where you used to live. I'm not sure how you will find out where it was heard, if there was even a court case.

    Nobody should be knocking on doors without a court order, but I wouldn't put it past the scammers. We have seen a few cases recently where letters have been sent to motorists saying they have received a CCJ when it was actually a total fabrication, but whether they have escalated this by visiting I have no idea.

    The answer to your question is still not here. Call the Bulk Centre in Northampton (or email them) with your name and your old address to see if there is a CCJ registered. If there is not, and bailiffs do return, it is highly likely this is a Council ticket as they do aggressively chase parking tickets with bailiffs. 
    You could also ask the DVLA who has been enquiring about your VRM

  • If you looked on Trust Online and ther eis no CCJ, then this is ALMOST CERTAINLY a council matter. 
    The timings add up more easily then, as they dont have to go through any court motions, and time from ticket to NTO to OFR can be quite quick. 
  • Thanks everyone for the advice so far, it is greatly appreciated!

    It is definitely PCM as I have a picture of my ticket and it says their name all over it.

    I also managed check my ticket online via the PCM website and it still shows up on their online portal (no personal details were inputted)

    I have phoned the local council where I parked and they have confirmed it is NOT from them and they do not use PCM to issue tickets.
