    Yes thank you all - 
    I may have misled you
    1. I have submitted WS and Defence. By the allocated time. 
    2. The claimant did not provide me with this evidence until AFTER I had submitted my defence and all the relevant documents. 
    3. The defence I used was posted herein prior to sending it. 
    4. The current state of play is a phone hearing date has been set - and I have now found the evidence which I have posted and will post again correctly here. 
    5. I have checked with the court that they have all the documentation and they are in receipt of this. 
    6. I have not received the SCAMMERS WS - Is this something I have to request from them prior to the hearing. I assume it is. And so I have emailed them today. I see that as they a. did not send evidence or b. Send their witness statement that I may already be in a less favourable position. I had to persue the Defence as per instruction here without their contact so as to meet the court filing deadline.

    6) They have the precise same date as you to serve and file their WS. What precisely is that date?

    But you said they didn't send a WS.  So, what do you mean by the above, a SAR reply?

  • Nos: I have asked for the date to be supplied to me by the court, as I have not been able to find it on the latest paperwork. It has long passed if it is the same date that the defence needed to be submitted. 
    Coup: The enclosed is what I received from the court so far. Yes I refer to the later found SAR reply. I have asked the court to supply date information.

    The date tends to be on the court order , possibly on the back , giving you a deadline for documents submissions , say 2 weeks before. We have seen many recent cases on here where defendants have missed this vital information and failed to submit their WS

    This has nothing to do with when the defence was filed with the CCBC

    October 2020? If that's the hearing date then it is unlikely that any WS will have been filed yet?

    On the back of the hearing letter. the one that told you the date of the hearing. What deadline does it give when it talks about documents.
