    UKPC do not own it. They do not own ANY car parks. Yes of course you presume it, same as everyone does. 

    Call the council and find out who pays the NDRs.

    So when you contacted the company I mentioned earlier who denied responsibility, did you think to ask them who does?

    I have just spoken to the landowner and he tells me they do have authority to issue tickets and take people to court as they have hired them to manage the car park, I asked if there was a formal contract regarding this and he said yes. I guess I just leave this part out of my appeal! I wasn’t convinced he really cared that much about it tho and didn’t seem too happy that I had contacted him!  Thanks for pointing out the obvious keithP I have almost finished my appeal now

    Always mention no landowner authority , regardless , make them prove it , many contracts have mistakes , omissions and incorrect witnessing etc

    I believe the PoPLA appeal portal and/or BPA CoP tells you that the scammers should respond within 35 days. If you haven't had a response by say about day 38, complain to the BPA.

    So I have received UKPCs evidence on the popla website and this is my first draft at a response, I can post the evidence they supplied if necessary it was basically a load of photos of signs and a witness statement signed on behalf of the landowner.

    In response to UKPC Ltd’s information and evidence I have several areas which I would like to make clear.

    Firstly the signage given as evidence shows how illegible the information presented is. Despite there being several signs at the retail park they are mostly high up on poles and use many different font sizes which makes it very difficult to read without standing directly infront of the signs and even then not being able to read it clearly. This highlights that although UKPC state they have landowner authority to issue parking charges this can only be done so in accordance with a contract being made and is based on clear and adequate signage.

    The witness statement is not actually signed by the landowner itself but is signed by somebody acting on behalf of the landowner, but there is no evidence to suggest this permission has been granted.

    The agreement shown as evidence does not have an expiry date and simply states ‘This authority is contained in an agreement dated April 2019 running in perpetuity until terminated. The date is not hand written which indicates it could have been written at any point. Furthermore only the signature is hand written at the bottom of the witness statement and the date is printed, again which could be altered.

    Finally I would like to add that are several spelling mistakes at the beginning of the witness statement on the spelling of both the name of the retail park and the town name which shows to me it has been constructed quickly and haphazardly and not adequately checked by UKPC, the landowner or the person acting on behalf of the landowner.

    You go through the PPCs response and refute everything that you disagree with, anything that they haven't commented upon, you take as being accepted by them.  You only have 2,000 CHARACTERS to make your rebuttal, so bullet points not sentences.
