County court claim, what to do now?

  • They said 10am leave 45 minutes to receive call. Nothing. Rang court at 11 & they said they don’t know anything & all they can do is email judge. Just sat here like lemons.

    A TASK FOR SEPTEMBER.

    The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

    You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

    At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.  

    And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

    Please be heard.  You can bet the hundreds of PPCs will be commenting.

    What happened? 

    We assume you had emailed the court a few days before giving your phone number?  Did they contact you?

    And did you make a diary note to make sure you and all your Facebook contacts, friends and family do the above (please)?

  • Yes, emailed the court with number on Wednesday. Didn’t hear anything back from them. If there is nothing in post Monday I will try phoning again but the receptionist seemed less than helpful saying there wasn’t anything she could do apart from email the judge as she doesn’t know what cases are heard.

    Oh dear.  I sincerely hope the claim wasn't heard in your absence or you will 99% likely lose (just to warn you).

    Do the consultations while all this is fresh in your mind.  The industry won't change unless the Government hear from real victims.

    It's usually the claimants responsibility to organise the phone link and get relevant phone nos. The call is normally connected by a professional operator - Legal Connect / BT / Kidatu. If you've not been connected that ought to be on C, with the hearing adjourned.

    I'd follow this up daily if necessary.

  • No, we were also informed in advance what number would be calling. 
  • Right, so we got in touch with the court today & there was a representative for parking eye on the phone but the judge didn’t have our evidence or phone number because when we emailed it we didn’t put the hearing date in the subject so it wasn’t picked up as urgent. Luckily they adjourned it due to circumstances & the case wasn’t heard in our absence. Awaiting a new date now.
