    I couldn't see that you have the usual point about no landowner authority or proprietary interest.
    And as this is ParkingEye, we know that they won't have added any false sums except for the £50 legal costs but they are hard to argue against. 

    However, you can mention the Consumer Rights Act 2015 Schedule 2, paragraphs 6, 10, 14 and 18 have been breached by the unclear system and lack of signs on the fence and put the CRA Sch2 in evidence at WS stage.

  • hi, the DQ was sent by email to the same email address that the defence was filed with on 30/3/2020 but still not showing up on mcol. Is this something we should be worried about?

    I'd forward it again, as the CCBC are working with 50% staff and they were temporarily closed for a few days last week due to a staff member having tested positive for the virus. 

    State that this is a second email, forwarded to prove it was filed and served in time, but you are concerned that MCOL has not been updated to reflect the receipt of this DQ.

    When you sent it originally did you receive an auto-response from CCBC?  Do you have a copy in your SENT folder?  Take a screen shot of that folder and keep it safe - just in case - but it probably is what C-m advises above.

    so just an update, they must have a real backlog because despite 3 emails including screenshots as proof, the DQ was filed on 5/5/2020 and received a letter today saying it has been transferred to our local court & we are to await judges directions.
  • Received this yesterday, despite following the guidelines to not have the hearing on paper. Is this due to the COVID-19 problems?
