Genuine payment to me had payment recall request from sender

This is a bit of an unusual situation so I have been told by my bank but here it goes... So I loaned some money to a family member some months back and after asking politely for them to pay some of it back there was a big argument and they transferred me the whole amount back in one go, problem solved... HOWEVER today, 3 days later, the money was taken back from my account and when I called my bank they said that the person who made the payment has requested a payment recall saying they have paid the money to a wrong account!
Luckily all of our conversations were made via text including her asking for my bank details saying this is definitely my account and not my partners (who she had sent the text to) and then a screenshot she sent to me of the payment confirmation to say it had been paid. I've given this evidence plus the fact she had used the same reference as the original payment when I loaned her the money and the bank have said that's more than enough evidence for her to not get the money back.

What I really want to know is if I can put in some sort of complaint with her bank against her for this? I know it sounds petty but she has given me nothing but trouble and we agreed that the money was to be paid back before I go on to maternity leave which I've already started now and because of my work loosing my maternity forms I'm not getting my first month maternity pay on time which i had explained to her and hence me asking for them to start paying the loan back! it's caused a lot of stress for me and she knew what she was doing was really wrong and I just don't feel its fair for her to just get away with it!
Thanks for any advice!

I don’t think you have any valid complaint with any of the banks, which have all apparently acted in good faith from what I can see. Your gripe is with the family member. If you now have the money back then I would just leave it though, and think twice about lending money to family members in the future.

If I were you and the money was paid back in to my bank account I'd let the incident go.

Chances are the family member who tried to recall the payment will get a letter from their bank terminating their banking relationship.  Lying to a bank isn't a very bright thing to do.

Just dont mix money and family/friends, it ends up in a mess.
I cant see what your complaint would be since the bank did nothing wrong.
  • Thanks for your replies, I was thinking more along the lines of reporting her to her own bank for, in a way, trying to scam me! I haven't got the money back yet and I won't for another week at least so I'm 8 months pregnant with a 2 year old and no money until then but my bank are confident I will. I know how petty it seems but its actually my partners family members partner who was messaging me saying they can't afford to eat and really putting the guilt trip on (I had literally just inherited a bit of money from my dad who died really suddenly just before this so i couldnt even say that i didint have it to lend but have none of it left after paying for a funeral and solicitors etc) i have let soooo much go from them as well and they said some seriously awful, unforgivable things after I asked if they could set up a standing order so I just thought a good dose of karma for what they've done would make me feel a lot better! (Selfish, I know!!)

The bank is not responsible for any agreement between individuals.    Her bank will not be interested in what you say and you need to be careful you do not get into trouble for defamation.  The issue is between you and her and no-one else.

I just wasn't sure if she could get in trouble for saying that she had sent the payment to a wrong account when it was a genuine paymemt and there was evidence that she had falsely made that claim to her bank

Her bank will not be happy with them for making the claim when you have proof it was genuine. This info will be provided by your bank to them.
So as someone else said. They can easily end up with the account being closed and a CIFAS marker placed. making it very hard to get a new account.
Banks really do not like people that abuse the system.

Are you sure? Can a bank simply recall a payment without checking with the person who received the payment if it was indeed in error? Otherwise I can see all sorts of shenanigans taking place with people getting goods delivered and then reneging.

They didn't check with me just took it out of my account but because it was quite a large amount I got a text to say I was close to my overdraft limit so I contacted my bank to find out what was going on.
