Mis-selling Car

Hi All!

I have a bought a car in Aug 2017 from Vauxhall and I think I have!
been sold a modified car which I wasnt aware of and need some advice on mis-selling a car.

Recently somebody has crashed into my car, third party was uninsured and this was confirmed by police as they are the ones who informed me about it.!
I ve done Insurance claim and few days later they confirmed that my car is written off, however they have put my claim under investigation as they found some modifications (Induction kit - Air Filter) in the car which I wasnt aware of. I ve been to Vauxhall, asked them about it and i ve been asked to email the GM. I ve had a replied thru email saying that they have reviewed the paperworks and they cannot see any information that would lead us to believe that the vehicle had any form of modifications. However my Insurance have contacted the previous owner and he has confirmed that he is the one who fitted the modified air filter and my claim is approved after 4 weeks of inconvenience.!

I have contacted Vauxhall by phone, email and physically went to the branch but they have kind a ignored and me kept telling that even if theres any mods they will remove it and put a standard vauxhall part which clearly proves they didnt and have mis sold me the car.!

I have in writing from Vauxhall manager saying there wasnt any form of modifications according to their paperworks and Insurance have confirmed by an email that they have confirmed it with the previous owner that he has modified. How far can I go with this case?

    How much are you after? As long as the insurance pays out market value for you car then you're not entitled to anything.

    So a car that was bought in 2017 & fully serviced in the mean time by who? And no one mentioned that it had a non standard air filter?

    What do you mean by how far can you go?

    You say the insurance claim has been approved so the car will either be repaired via insurance or written off. If repaired then Vauxhall have said they will change the modified part for you so what's the problem exactly?

    The previous owner made the modification and obviously didn't declare it so the dealership were unaware when they sold it to you, now they know they are willing to rectify it.

    Vauxhall never said they will change it. They said when they buy the car of somebody they check the car in and out and any mods car has they remove it and put a standard part before selling it.

    Previous owner said that Vauxhall have checked the car before they purchased it off him.

    I service the car in a local garage not with vauxhall directly.

    What i am trying to say is when my claim was put on hold, I physically went to Vauxhall and requested the information and they have clearly said that according to their paperworks there wasn't any form of modifications. Even if the car has any kind of mods they remove that part and put a standard vauxhall parts.

    As Vauxhall mis-sold me the car I was actually driving with Invalid Insurance, what if the previous owner wouldn't confirm it. My whole claim would have been cancelled and my policy.

    These 4 weeks have been nightmare for me bcz Insurance have took the courtesy car of me bcz my car was confirmed written off after 1st week. For 3 weeks my mrs was struggling for the school runs, I ve spent lot of money in taxis going to work and the time I spent chasing Vauxhall even when I was at work. Just bcz of Vauxhall who didn't inform me of the mods and they didnt even helped me when I was chasing them after this incident.

    This incident have cause me a lot of Inconvenience and stressed for me and my family. What If It was a serious accident and If I couldn't prove this modifications werent done by me.

    What if, what if, what if.

    Itemise your out of pocket expenses and put in a claim if you feel that strongly about it. You're entitled to nothing for stress.

    You should make a complaint to the selling dealer and advise they pay a bit more attention when selling cars.

    We are talking about a modified air filter, aren't we? On a whole car with hundreds of parts. And you specifically asked that the car you were buying was standard in every way and not modified?
