mis sold vehicle

On the 9 Dec I purchased a car from a dealer through hire purchase, the car is 2 years old and had a advertised mileage of 17000 .



The salesman informed me that the odometer was faulty, but I could take the car and arrange to have it done at my local Vauxhall garage, as the car was still under warranty and if Incurred any cost they would pay. I did this,only to be told that the instrument panel did not belong to that car and it was second hand.



Vauxhalls told me that they had to email Germany to get permission to reprogram the car,it was granted.



After they had reprogrammed the car they informed me that the actual mileage was over 34000, I am in the process of rejecting the car.



The dealer has admitted the car was mis sold and it was mis sold to him by his supplier.

My main concern is that I will be the loser as the finance company will be reimbursed and he will from his supplier.



I will be without a car and I will have to reapply for finance with no guarantee of getting it. I will be rejecting under the 6 month rule

  • Why is the extra mileage such a deal breaker?

    Given the extra mileage I guess you didn't look at the service history prior to buying it.

    Where is your loss? You have offloaded a dodgy motor that has been messed with. And now you get to choose a new motor. No different to if you were to keep the original until the point which you wanted to change.

    So how you will you be "the loser" in this? You're going to be put back in the position you were before the purchase.

    You've got a straight choice...

    You either reject the car and get your money back...
    Or you keep the car and accept it's a little bit leggier than you thought. 34k on a 2yo car is not exactly scary. Perhaps they'll see you right for the difference in value?

    And that's something that you need to consider as part of the rejection decision.

    Perhaps the supplier has another car you'd take instead? Perhaps the financier will simply change their finance to that car?

    There is no "six month rule". Six months merely changes the balance of proof as to whether an issue was present at the time of sale.

    You aren't even relying on any legislation here - the supplier has done the right thing, and said "Yep, that's a wrong 'un, and it's coming back."

    However, I suspect they knew damn well what the score was - a 2yo car would be under manufacturer's warranty, so why didn't they sort the "broken" odo before sale...?

    Yes, and the dealer have accepted that. And are giving you a full refund.

    Let's get to the nitty-gritty... How much more do you want them to give you?

    And what did the service history say about the mileage?

    I don't know why your so hung up up on slightly higher mileage.

    Just reject it and buy another.
  • Because it would be a lot cheaper if it was advertised with 34k miles
  • If you read the post the instrument panel is second hand, so you have to wonder what else is not genuine
