@KeithP - Thank you.  I can't see any reference to a claimant's request.  Thanks for clarifying.
I've sent my questionnaire (via the online form, much neater!).  Can I send the copy to BW Legal by email?
If BW legal is the claimant and they have communicated with you previously be e-mail then yes, otherwise by post.
@Le_Kirk - The claimant is 'Kbt Cornwall Ltd' and I have an email response to my SARS request from 'Armtrac Security Services' and at the bottom of the email it says 'KBT Cornwall Ltd T/as Armtrac Security Services'.  I don't want to sound pedantic but can I send it to the Armtrac email address I received the SARS response from? Thanks again.

On Friday of last week, however, I received a 'notice of intention to proceed' from BW Legal.  Again, it includes threats of a CCJ "being likely to be entered against" me and giving me until the 27th Match to pay up.  Can I ask if this is a tactic to try and intimate me?

BWLegal are masters of intimidation to the point of stupidity.  These nonsensical bods cannot threaten a CCJ
Such amazing stupidity when they will probably get spanked anyway for scamming.

nonsensical =  having no meaning; making no sense.and it would be a good idea if "nonsensical" would be the BWLegal logo.    Sure it will go to court, sure that they will send one their half baked legals and sure, they will have no answer for their scam £60 .... AND THAT IS WHY BWLEGAL GET SPANKED

At this stage, you can send them an email asking on what LEGAL authority they have to add an unknown amount.       They will either ignore or reply with some nonsensical stuff that does not give authority

It is the scam operated by BWLegal that you bring to the attention of the court

Get your costs schedule ready for when you win and the judge spanks them again..Now they know, that you know about the fact £60 ....... they may just chicken out again and discontinue
I guess it doesn't hurt to send them an email! If they respond they won't be able to justify it anyway.  I'll have a look around the forums for some examples and put something together!
  • Your defence was good by the way and this is all normal from BW Legal.  They will proceed further but they often discontinue claims shortly before hearings/witness statement and evidence stage, and if they don't, then posters here filed a strong WS & evidence and then usually win at the hearing anyway.

Likely to be ages ahead, given I suspect many cases will be postponed now.
Thanks @Coupon-mad - When I went back over the Newbie posts yesterday, I was a bit worried my defence might not be that great, so I do appreciate your reassurance.
I was hoping that that was the case.  It smelt of desperation.  I'd just filed a defence, so they must surely realise I've done a bit of homework (or relied heavily on the knowledge and experience of you guys smile: ) and that I wouldn't then just say "hey, ok, I'll pay £253.54"! So soon after filing the defence too.  I suspect I'll get a few more between now and the hearing!

A counter  claim will ensure that, even if they discontinue, they will have to defend, or settle.
@D_P_Dance - excuse my lack of knowledge but would that be if I decided I wanted costs for my time? I think I've seen £19 per hour? And somewhere there's guidance on what to claim for on the forum, I believe.
If you'd asked me that question when I first received their LOC I'd have said I'll just settle but the more I read about these companies the more I want to give them a bloody nose!

You must serve on the claimant (Kbt Cornwall Ltd) so the answer is the same, if they have communicated with you by e-mail, it is OK to do so with them.  Not sure about using the same e-mail address as you did for the SAR as that was likely to be to the DPO, however their web site contains this useful information: -

And that is the point ..... they cannot justify it so they either come out with more rubbish or they ignore.
Both can be referred to the judge

  • Hi all.  I've received another letter from BW Legal, essentially telling me Armtrac is willing to settle out of court for £180.  Just to be clear, I have no intention of settling but I was curious to hear other people's thoughts? What I find peculiar, or perhaps this is just another example of how rubbish BW Legal is, is that they've given me a week to accept their offer but the offer started on the date the letter was typed, the 8th April and I've just received it today, the 14th April, giving me just over 24 hours to accept (the deadline is 4 pm on the 15th April).  Was this done intentionally, for some reason? I know we've just had a weekend and two bank holidays but surely you'd take that into consideration when sending the letter? I think what I'm driving at is this some attempt for them to try and show the court that they were willing to negotiate and I'm the difficult party, yet they're going to make it harder than necessary for me to take their offer because of the short window I now have to accept it.  Does that make sense? Any suggestions in regard to if/how I should respond would be appreciated.
    Thanks!
