In #2, you've put £178.54 but it's not meant to include the interest.  In most cases that sum is meant to show £160.  You have also typed there that the Beavis case fine was £385!  You mean £85!

Also this bit you have added as #17 needs to be changed from ''I'' to the third person, 'the Defendant' and remove the stuff about the CAB as the CAB are currently (sadly) useless about private parking charges and you shouldn't put a CAB link in a defence:

    17.  I was given this penalty notice while I was in the Argos store located next to the car park.  I believed that the car park belonged to Argos and didn’t suspect that it was a private car park that was nothing to do with Argos. I would also like to point out that there are two ticket machines but one is concealed behind the Argos store and not visible from the car park and the other is in the car park for the Tyacks Hotel.I would also like to point out that ATA members are required to give a grace period when using their carparks of 10 minutes. I was in the store for less than 10 minutes.

(remove the CAB line and link)

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've also had another threatening letter from BW Legal telling me to pay up or they'll enter a CCJ against me!
After reading this forum, you will realise that BWLegal talk utter crap. Of course they cannot enter a CCJ against you ...... they are simply a jumped up legal who are well above their station in life. Only a judge can decide about a CCJ and not a very poor excuse for a "Kray Twins" style operation who keep getting spanked in court for false claims ...... Nobody can take BWL seriously ... even the courts, they are a complete joke .

The BWLegal case I attended confirmed this, they even signed a statement of truth which was an outright lie

The quicker the SRA understand that this bunch are not fit for purpose, the better humanity will be.

@beamerguy   It did make me chuckle when I read the letter.  It's sad for those who aren't lucky enough to come onto a forum like this and see that companies like BW Legal are full of blatant lies to try and scare people into thinking they're going to have a CCJ against them if they don't cough up.   :/

You did see to also attach the Southampton 6 page transcript as Appendix C, as per the thread about the template?

    @Coupon-mad - Thank you!
I've amended the Beavis cost and the cost in my case.

I've updated #17 to:  The Defendant was given this penalty notice while they were in the Argos store located next to the car park.  The Defendant believed that the car park belonged to Argos and didn’t suspect that it was a private car park that was nothing to do with Argos.  The Defendant would also like to point out that there are two ticket machines but one is concealed behind the Argos store and not visible from the car park and the other is in the car park for the Tyacks Hotel.

I've also completely removed #18 about the CAB.

I do seem to be having some trouble with the appendices though.  Are they available to download separately? I can't see appendix C at all.  I can see Skipton and Warwick, but they seem to be embedded in the template and I can't download them to add to my defence as I typed it all out again because it didn't appear right in WPS Office, which I use as a word processor.  As for appendix C, all I have is the title in red and nothing below it.

The word Bull-sh*t comes to mind for all of them. What amazes me is how all of them have allowed themselves to be so degraded.   The great thing about the MSE site is that the posts show up in Google quickly so anyone can just google their name, and up comes all their rubbish.  How mad is that

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

" The Defendant was given this (penalty) notice ........"   -   do you mean (parking charge)?

@Beamer@beamerguy - I guess the trouble is that there aren't enough people looking into their bull-sh*t.  People see the scary legal wording, panic and pay up.  Going through this process does make you realise how little the consumer is protected against these cowboys!

You are correct ...... it's always open to write back to BWL and say they spout nonsensical rubbish, a word they like to use which in turn is nonsensical
  • @Umkomaas and @1505grandad - thank you for your help with amending the defence!
I've added the Britannia V Crosby to my Defence as appendix C but only the 7 pages mentioned of the approved judgement.  I've converted the .pdf to .jpg, so others can add it into their defence as an image, as I've done.
I think I'm ready to email my defence now but if any of you wonderful people are around to cast your expert eyes over it one more time, I'd be very grateful!  o:)
  • My computer and scanner both froze and so I have literally just sent the defence over.  I sent it in 2 parts with the appendices attached too.  I hope it's ok?!
