    then consider a counter claim , to be put in and paid for with the defence

    put the boot on the other foot , try for either £500 or £1500 due to this effect on somebody covered by the EA2010

    OK so hold on and reply if you want to work on a counter claim as it has to go in at the same time as the defence.

    Please summarise the basics and why you think disability discrimination has occurred, and we will try to use that in some counter claim wording.

    I rarely look back at older posts, hence please give a precis of the issue and the disability and why the treatment (PCN) is discriminatory, to your mind?

    Counter claim for damages and distress to a disabled person caused by direct discrimination,and indirect discrimination in contravention of the Equality Act 2010.

    Defendant had already told Excel about their disability issues and that they had purchased a valid ticket. Therefore Excel already knew about the disability. They had acknowledged the disability, following the appeal as they made a demand for a further payment of£ 20.00 for what would have been classed as their attempt to make a reasonable adjustment for disability. Under the Equality Act a disabled person cannot be made to pay for a reasonable adjustment!

    to continue with the threatening letters and eventually issue a country court claim could be seen as victimization, harassment.....especially........... to continue to take a disabled person to Court when they had previous knowledge of disability is direct discrimination.

    They failed to make reasonable adjustments for a disabled person even though they had already been alerted to the fact of Defendants disability

    It is direct discrimination because they failed to make any reasonable adjustments, they treated the Defendant the same as an able bodied person

    victimization under the Equality Act. requires compensation from Excel and the landowner as they may be liable too


    I have read something regarding compensation for injured, hurt feelings in the Equality Act 2012

    Are they required by law a duty of care, to present this car park in a reasonable condition....... properly maintained and repaired........... in a safe and fit for purpose and fit for the use.............. of any user but especially the disabled

    Any advice for a counter claim?

    The original Defendant is disabled and would like to make a counter claim for damages under The Equality Act 2010. for direct and indirect discrimination and injury to feelings for the amount of £????. (are court fees based on the amount claimed?)

    The Claimant had previously been been notified by appeal, that the Defendant is disabled, EA2010, and had purchased, a flimsy parking ticket.

    Because of the Claimants continuous, malicious, pursuit of this unfounded PCN. The Defendant has suffered injury to feelings and extreme stress. Excel Parking's has been determined to continue with perusing the Disabled Defendant, in the hope that they can bring to bare, such anxiety and stress to the Disabled Defendant, that they will, in the end, obtain a monetary gain from the Disabled Defendant, to which they are not legally entitled.

    Excel parking has caused the Defendant, injury to feelings and extreme distress and anxiety,
    considered to be harassment and victimization under the EA2010 and the Defendant has therefore suffered both direct and indirect discrimination by Excel Parking.

    It should also be noted that the Defendants disability/illness has been exacerbated by this stress and has affected them greatly.

    are court fees based on the amount claimed?
    Yes but they are not expensive - Google the info - and do you pay court fees or do you qualify for help with fees, check that online too.

    I will think about your counterclaim a bit more this week. Reply if your thread drops right down for days.
