CPM Parking Charge Notice on L&Q Housing Association Estate

Hi there,

I've read the **NEWBIES** thread quite a few times and think I have a grasp of it, but I wanted to post for a sanity check.

Last night my vehicle was issued with a Parking Charge Notice from CPM. The only reason listed is "No permit". The driver pulled up for three minutes to collect his daughter from the childminder. The childminder lives on an L&Q Housing Association Estate, but the parking is a residents car park with a permit scheme run by CPM.

I have written to my MP, the management company for the estate and the council to complain.

As it is CPM I need to follow the IPC instructions in the newbies thread right? So I wait for the NTK, then I copy and paste the template into CPM's appeals form? I've visited there already and it says I only have 21 days to use that form?

I've screenshotted all the photos taken of the vehicle along with the parking sign and am keeping all details.

I read somewhere else that only 20% of IPC appeals are successful. It seems like a very long winded process to get out of this so I'm really hoping one of my complaints gets a result before we get there. I can't believe a Housing Association estate residents car park has been given over to these crooks!

    You seem to understand what to do , but as you say it's best to get the PCN cancelled by the management company as quickly as possible

    UKCPM are very unlikely to accept any appeals , but 3 minutes seems a reasonable grace period which it would be for a BPA member

    Until the Mhclg sort out a new CoP , it won't change

    You appear to have done all that is necessary. If they are daft enough to take you to court they are likely to struggle imo.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers when the legislation is enacted.,

    You never know how far you can go until you go too far.

    Just as an update, the council responsible for the area actually confirmed that the estate is housing association, managed by L&Q Group (can't post a link as I'm a new forum member).

    They sound like a nice company, Google "Guardian mortgage prisoner"...

    I've emailed their CEO, David Montague, as well as making a complaint on their website, but I'm bracing myself for a standard "this isn't our problem as parking is managed by CPM" etc. Perhaps I'll be pleasantly surprised.

    was counsul , now housing assoc , BUT have the TRO been revoked in the area , and I suppose the street lighting is paid for my the residents , and drains ,,,,,,,,,,,,,,,
  • just to add . the HOUSING stock has been handed to housing assoc the roads etc are still counsil responsibility . contact counsil and ask correct question

    Sorry, I'm having trouble following you. Are you saying I should send another complaint to the council stating that the housing stock has been handed to the HA but the roads are still a council responsibility?

    Just to clarify, the ticket was issued while the vehicle was on the private road of the estate, not on the main road.

    Sorry, I am not well versed at all in things like this so I'm struggling to grasp what my rights are and who is responsible...
  • the whole area was council , the HOUSING stock was passed to housing assoc , the roads in the area are still under counsil control and maintainance

    NOT a complaint , you ask the CORRECT question , if land is still counsul owned then they cannot ticket

    Apart from trying to get the landowner to cancel this scam ticket, pus a complaint to your MP pointing out there is case law that covers brief loading/boarding/assisting a child to alight at residential car parks, there is nothing to be done except wait to be sued by UKCPM then win it based on Jopson v Homeguard (search the forum, no need for any more input from us right now at first PCN stage as there is no appeal).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
