The problem with relying on that that is that this isn't a criminal trial and the insurance company don' t have to prove "beyond all reasonable doubt" that the driver knew - they'll work off balance of probabilities.
And the balance of probability is that if someone owns a car with a remapped engine, they'll know about it. If some boy racer driving a tricked out golf/corsa/whatever claimed they didn't know the engine was remapped, would you believe them? I know I wouldn't.0 -

I'm referring to the OP's Facebook etc, some Insurers will check it in the event of an unusual claim and people with tricked out cars tend to mention it on their Facebook

It's not really pedantry - calling it "road tax" leads to the quite commonly held belief that motorists have some special entitlement to the roads. See all the "you don't pay road tax" arguments against cyclists. Language is powerful and our choice of words has an impact outside of their direct meaning.0 -
