I have received today replay from DVLA to SAR.

As expected it states that vcs requested RK details due to: breach terms and conditions of a private car park.
It was requested electronically and generated automatic responses.

Can I tell DVLA that I do not give them my consent to share my details with any PPC?

Nothing from vcs regarding SAR yet.

Thanks Coupon-mad. After posting, when in bed I have had feeling that there was another place where "choking" was mentioned.:) I will edit it out.

You can tell them what you like, but note that they have the authority of Regulation 27 of The Road Vehicles (Registration and Licensing) Regulations 2002.

    Thanks KeithP.

bergkamp kindly provided 2005 DSA byelaws

My another concern is whether 2005 issue byelaws are current, as vcs was claiming they were not, in this post:

    https:// forums. moneysavingexpert.com / showthread.php?t=5967438&page=3#topofpage #44.

    11. The Claimant notes from the Defendant's witness statement that the Defendant refers to the byelaws of Doncaster Sheffield Airport published in 2005. However, the Site in question is called Robin Hood Airport. As such, the Defendant is put to strict proof that the byelaws apply to the Site on which the Claimant is contracted to provide a parking control service.

Is vcs correct, as Airport is still called Doncaster Sheffield Airport?

The byelaw, in the Interpretations, cover the issue in that the 'the airport' means '...all areas... within the area delineated in red on the map attached to these byelaws and marked “Map referred to in Doncaster Sheffield Airport Byelaws'

Ask them to demonstrate the airport lays outside of the area delineated on the map.

    Quick update after few weeks,
I have received DQ from Court which was completed and returned within required dead line. I have not received copy of DQ from claimant. What I have received from claimant was SAR - but it was sent to me by excel parking - strange.
Claim was transferred to my local court:)
Now I am awaiting hearing date and already preparing witness statement.

You seem to be telling us that you sent a Subject Access Request to Vehicle Control Services Ltd but Excel Parking Services Ltd have responded to that request.

These are two entirely separate companies.
Looks like a massive breach of the Data Protection Act to me. Otherwise how could Excel obtain your personal data?
