Premier Park Ltd CCBC

Hello!

Lived in a student Unite residence during 2018. Sometimes parking behind the building and using the daily Unite parking permit. First time, claim for 08/02, I didn't realise but the permit had fallen down. Second claim was on 23/2 and there was no issue - permit was valid BUT I was still given a ticket for no reason.

I thought the paperwork all related to just 1 incident, and have no proof of the 8/2 day. I do have a picture of 23/2 permit on my car and being valid. I appealed for this to PP Ltd but with no success. It slipped my mind to appeal with POPLA.

Fast forward, I now have a CCBC from Northampton for the incident on the 8/2. I've done the AOS. I need to do the SAR, but is it worth asking Unite to cancel this again? And how do I best argue this defence in this unusual situation?

    read post #2 of the NEWBIES FAQ sticky thread, where there are 17 examples of defences, also read other defences on here, starting with the one by coupon mad in the basher52 thread

    I doubt that UNITE can cancel this now a court claim has been issued, but try them anyway, even if its for a witness statement

    [FONT=Times New Roman, serif][FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Please reply to this telling us the date it was issued. Your priority is your defence.

    Apologies. I've been away. The issue date from CCBC letter is 19/12/19. I will do the SAR tomorrow, too.

    On what date was an Acknowledgment of Service filed?
    The MCOL website will show the definitive answer.
    I'll assume it was after 24th December. Please confirm.

    With a Claim Issue Date of 19th December, and having filed an Acknowledgement of Service in a timely manner, you have until 4pm on Tuesday 21st January 2020 to file your Defence.

    That's two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are trying to keep you under pressure. Just file it.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Yes the AOS was submitted on the 26th from me, and received on the 30th December.

    we mean it about giving plenty of time to write a defence - 2 weeks is AGES. You have 17 defences to crib from and *understand*, you can do this in a couple of hours.

    Same advice as the other two Premier Park ones I just replied in in the last half hour, really! Please save me typing a la Groundhog Day stylee, and click on my username to read my posts tonight on 2 Premier Park threads at the exact same stage, already.

    I suggest you attach the same Warwick Premier Park judgment/order that I told the other two to attach, and make sure your defence is as good as theirs and includes everything.

    Correct, everything was done online.

    I believe my local is Bristol. Just writing up defence and will post draft soon. £60 has also been added on to the amount wanting to be claimed, that will be talked about in my defence!

    If driver has not been mentioned as of yet, does that stay without being talked about?
