Post received today showed another WS dated 6 days later! Exactly the same content, although now in a larger font, and with the exhibit pages numbered (they weren't before)1

Good evening all - after 2.5yrs I'm finally free of this stress, as case dismissed!! Of course, couldn't have done it without the help from here as the support has been tremendous. The person attending from BW Legal definitely gave a fair few questions to me. These included pinpointing me as a driver, seeing the signs and what they "clearly show", and how I had the responsibility to make sure the permit was in the windscreen. He referenced an exhibit of the paralegal that wrote the WS, although the Judge was vexed when her copy was not numbered (this was the original copy that they sent out, and Judge must not have seen the second copy - made me looked really good when I could just name my page numbers!); she also commented on their poor picture, as one was predominantely light reflecting on a screen in the sun rather than a clear dashboard.
In the end, it was the judgement that my permit (that fell) in the footwell was displayed, albeit in the car and not in the windscreen, but was understood to happen as it was very flimsy and even a small gust of wind could have blown it, thus case was dismissed. The additional charge of £60 was not recoverable, and Beavis was quoted. The parking sign was also deemed to be particularly small and unclear on charges (71.2 CRA 2015 and other examples) .
On a positive note for others, Judge said that can this solicitor please highlight to Premier Parking Ltd that any claims with such additional cost involved will be struck out!
He wished to appeal as he said evidence doesn't show this, along with some speculation of his, but Judge said she had made her judgement and there would be no appeal.
With regards to costs - i only put £20 as my internship was online so could claim for an hr, but as that's all changed now, I did not claim that. Judge said the other LiP and rates weren't going to be applicable (or something along those lines) - so no money gained from the time all this has taken, but nothing paid out!
Please feel free to ask any questions and I may be able to answer... But again, would not have been able to do it without all the incredible support on this website.7 -
Sounds brilliant! I too have come across a Judge who wouldn't order any costs at all - but a win is a win!
Well done! ANOTHER PREMIER PARK LTD ONE BITES THE DUST!
Which court and Judge was this, who warned PPark that they face their cases being 'struck out' in future if they include the false £60 on top? Is it one that has struck cases out before, or not?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Interersting, I think that this should be brought to the attention of the SRA.

When going through things before, I couldn't see anything for DJ Byass; however looking now at forums for DJ Brown, there's this from March:

Above sounds quite similar to my hearing, although mine was over the phone and with a Solicitor agent from PPark!3 -
well done! ALways good to hear, and the solicitor, an officer of the court, now has a direct instruction to pass to their client .3

Hopefully they will pass this instruction to all their PPC clients, not just this one.You never know how far you can go until you go too far.2

That would be great if Bath start striking cases out, too!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
