    It was the SAR. Interesting thing about it is the ntk is not dated. Its just got an issue date, and the reminder is dated at the top like it should be. I think they missed the 14 day window, and are trying to cover themselves.

    The 'issue date' is the date of the NTK, unless they wrongly put that as the date of the parking event (one PPC did that for a few months!).

    Hello all, I hope in these turbulent times that you are all safe and well. 
    I have not been on here for a while because I have been taking care of the processes myself not needing to bother anyone for advice. 
    Although Yesterday I received a letter (see picture) from the court ordering that it be struck out!
    Please if someone could confirm my thoughts that I have in effect won!
    I would be very grateful.

    Woohoo!   Looks like Luton Court are getting fed up with PPC claims as well...

     'no serious attempt to comply with the CPRs'
    'stylised particulars do not constitute compliance'.

    Love that Judge's choice of words!  BW Legal claim struck out dead.

    However, 'stayed' just means frozen for now, unless they fail to comply by April Fools' Day.  Maybe in the current climate they will drop the ball, but wait until you are well past May just in case they plead they were in lockdown and need an extension and get it unstayed after all.  Unlikely but no throwing your files away this Summer, IMHO.

    I assume your first defence didn't put the claimant as UKCPM...as per the draft I just looked back at...given it is Premier Park?

    Here are the offending basic POC that the Judge didn't like:
    PoC:
    The Claimants Claim is for the sum of £XXXX being monies due from the Defendant to the Claimant in respect of a parking Charge Notice (PCN) issued on XXXXX (Issue Date) at XXXX at XXXXXXXX (ANPR)
    The PCN relates to XXXXX under registration XXXX.
    The terms of the PCN allowed the Defendant 28 days from the Issue Date to pay the PCN, but the Defendant failed to do so.
    Despite demand having been made, the Defendant has failed to settled their outstanding liability.
    The Claim also includes Statutory interest pursuant to section 69 of the County Courts Act 1984 at a rate of 8% per annum a daily rate of 0.02 from XX/XX/XXX to XX/XX/XXXX an amount of XXXX.
    The Claimant also claims £60.00 contractual costs pursuant to PCN Terms and Conditions.

    Have you asked for unreasonable behaviour costs under CPR27.14(2)(g)., has to be worth a stamp.  
    You never know how far you can go until you go too far.

    Thanks @Coupon-mad for all your advice on this, yes I did change the original defence to the correct name.
    It was very stressful when I received the first court letter. After ignoring all others I had no idea what to do. But with all the great help and advice on here I managed to get some understanding. I really appreciate above all your patience with me at the start because I was rushing and not reading the threads properly.
    BW did phone me about a week ago, but I declined to speak with them, obviously it was down to this judgement. I'm not sure about claiming for unreasonable behaviour I would rather leave it and give them less to do at this troubled time. If that is indeed how it works.
    Thanks again for all your help, it really does make a big difference.
