    similar to all the others , but the defendant is only liable if they were the driver , or if the PPC followed POFA

    there was one case today where the judge stopped the claimant from calling the defendant the driver because they had said they were not driving

    in another (or same) case the claimant had not followed POFA so was pulled up about it

    get on with drafting your defence , after reading the half a dozen recent winning cases on here and cribbing from them. nobody said you had to do it from scratch , so read the CEC16 thread , the basher52 thread and the abuse of process thread as well


    if you arent reading those, you arent doing your tasks properly

    I sent the SAR on the 22nd Dec so not long but waiting 30 days takes me past defence filing day (22nd Jan)

    yeah we know , so stop waiting for it and get on with your defence

    your SAR gave 30 days notice, so why you expect it beforehand is beyond me !! add 30 days to the 22 dec 2019 and that is the deadline day, or add one more day to it for deadline day , its been about half that with the holiday shutdown inside it

    your defence submission date was final, nobody said leave it to the last minute , in fact KeithP told you not to, because he tells everyone that and everyone ignores him

    I wasn't planning to leave it until the last minute at all. I have ignored all letters from them until now I have very little information, in which I thought I needed to draft a defence. Since I'm understanding from you that I can go ahead and draft a defence without the SAR. Thank you for clearing that up for me.

    Haven't read back through the thread, but what are you hanging on that you hope the SAR will reveal?

    What are you hoping will come from it to substantially change things in your direction?

    I said start drafting your defence, as did KeithP in his what to do by when post

    your defence is not dependent on your SAR reply, in fact it probably wont help you to draft your legal defence, it is of more use to you later down the line in a few months time at the WS plus Exhibits plus costs schedule stage

    the fact that the 30 day deadline for the SAR reply exceeds your defence deadline also tells you to get a shift on with your defence draft , plus those threads by Beamerguy , CEC16 and basher52 have been there since before you were advised to draft your defence before xmas

    your next reply should be your draft defence, once you have read say 20 other defences from the last 6 months , especially the winning ones that have concluded recently or in the last 6 months. I have read maybe 4 to 6 today alone, plus replied to other people on here as well

    tempus fugit , tick tock , tick tock , halfway there and nothing done as yet

    1. Because I haven't done anything like this before so was unaware it was unimportant (at this stage)
    2. I thought that if I have their letters they sent to me originally and they missed dates of first contact etc. ANPR is 14 days I think. Then that is a defence point. But from what you guys are saying. I'm thinking along the wrong lines. Sorry for wasting your time. Next post is defence.

    Yep, that's a good one to check out, provided the driver hasn't been identified.
