First appeal Template letter

Hi,

I've read the NEWBIES thread and have a question:

I've received a NTK from myparkingcharge.co.uk, an IPC member, but the thread says appealing to IAS is a waste of time. Who do I email the template letter to? There's no other email address on the notice.

Thanks

You send it to whichever address the NTK says to use for appeals, not that it will work. Search the forum for IPC see you in 2020 and read threads.

  • Thanks, the NTK says to appeal or challenge the notice online at myparkingcharge.co.uk , I'm reluctant to enter all my details on their website but I guess they've already got them?

Yes, you can safely put in your data as they have it already, but no saying who was driving. Or ignore them. Your choice, makes no odds really.

Either way, unless you can get the LANDOWNER to cancel the scam (ask immediately, complain!) we will see you in 2020 when you get the inevitable court claim, so start reading defence threads and see all the successes.

Excel or VCS, we assume. Which car park?

  • VCS I think, that's the first few letters of the reference number. It's Gallow Gate carpark in Newcastle upon Tyne. No idea who the landowner is, will have to look into it.

Yep, googling required. Sometimes local businesses will tell you who the landowner is, if you're assertive and nice.

You haven't said what the alleged infringement was. But for the purposes of the complaint, the main thing is what occupants of the car were doing - was money spent? If so, say where and how much. If there's a history of repeat custom, that's relevant. If the car park was confusing (aren't they always!), mention that. But focus on the customer or business side of things - retailers and their landlords WANT customers, they do not want to deter them and you (plural) want to go back. Unless of course the last visit incurs a huge surcharge ....

Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, as it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
You never know how far you can go until you go too far.
  • It's not attached to any particular business, mostly offices, it's in the middle of Newcastle right next to a large council carpark, which I genuinely thought it was part of. I've often used the same carpark in the daytime and paid for my parking. The council carparks are free after 6pm so having parked at 7.30pm in what I thought was the council carpark I assumed it was free. It was particularly dark and rainy that night making the already crap signs even harder to see.

That'll be your defence main point (among others) then! Can you get some photos of your own in the dark, and/or screenshot their photos now (whilst you can log in) as they will pull them later on.

Keep all the letters as well, as this will result in a claim but we tend to win them!

So I've received the rejection letter and VCS are now directing me to appeal via IAS. They even bothered to print all 8 photos they took in full A4 colour!! What next, sit tight and wait for more letters, or send a pointless appeal to IAS? Guidance much appreciated.

The guidance you are looking for is already there... in the NEWBIES thread.

In short - ignore the IAS.
