It was out of the 1 year but I believe Apple, have a warranty up until 6 years if bought direct from them.
Three are trying to get myself to pay for the repair then take it off my bill. I don’t believe that’s acceptable.
Apple have admitted after inspection at local Genius Bar, that it’s a hardware issue with the handset not caused by wear and tear. They’ve advised that Three need to agree to repair it via Apple under consumer rights law as it’s over 12m.
Three are dragging their heels and refusing.0 -
If it had Apple care+ the Apple store would have fixed it, regardless of where it was bought. So I doubt this is the case. Not even sure a 3rd party (like Three can get it on your behalf).
Since it's out of the 1 year warranty I don't believe Three has any obligation to pay for the repair under consumer law. It might be part of the contract you have with them. In any case I would be all over Three's offer to refund the repair, even if it's with account credit for the foreseeable future.
I think you are getting confused here. The Consumer Protection law, is right to return faulty goods is not a warranty. You need to demonstrate that the fault was in place at time of purchase, which is obviously not the case here. It doesn't give you free warranty if something breaks with age.0 -

You don't have Apple care +
Apple Limited Warranty of 1 year has expired.
So you are relying on the protection of the Consumer Laws in the United Kingdom. Which only covers defect exiting at point of sale, which is not the case here. The button/switch was functioning at the point of sale and continued to do so for over 1 year.
You should be looking at the specific T&C in your contract with Three, as this is your only source of compensation. If it states Three would compensate you for a broken down headset with "store credit" that's what you are going to get. You have no statutory rights in this case.0 -
Products should be fit for purpose. A handset should not break within 6 years, let alone a year.
