Three

Hello everyone.

I have a business contract with Three They supplied me with an iPhone 8 which developed a fault where by the mute/silent button was permanently on. I took it to my local Apple Store who agreed it was a fault with the phone and not my doing. But, as it was supplied by Three it was their responsibility to repair or replace the handset.

Three won't do this. They've offered for me to get it fixed, pay the rather hefty repair bill from Apple and then credit my account each month until they've paid off the bill.

Can anyone give me some advice legally where I stand? From my perspective, Apple are the manufacturers so they should repair/replace. Also, Three should also replace/repair.

Any advice would be appreciated.

    Get three to repair. Your contract is for the airtime, not the phone.

    You mainly. As stated you get the phone as part of the bundle. Liaise with Three. Or you could do an online chat with Apple and get them to pick the handset up/ repair/ return. However if the fault is found to be physical (and in your control) then you may have to pay for the repair. Best just dealing with Three.

  • Not sure if you've read the initial post. Apple have already examined it and agreed that it's a fault with their handset, and nothing I've done to it.

    Yes .
    But the rules for business depend upon your business contract with Three .

    Having spoken again with Apple they've advised I need to get Three to contact Apple and go through a Consumer Law case.

    AFAIK It does, unless the contract contradicts it. In which case the contract takes precedent.

    Unlike in B2C where the contract can't overrule the Consumer law.

    Is it still under warranty? It's likely to be only 1 year for business. If so Three should be taking care of that or if they send you to apple it should be free of charge. Not for you to pay and they to refund.
