    Oksy, I sent the V5, as suggested. I now have the following email in response.
    I have had no response to previous questions I have sent, but they are refusing to answer any more questions until I tell them who the driver was, or the date has passed.
    Should I tell them, or wait for an NTK? Their deadline takes me to day 47. There are still questions I wanted them to answer.

    We write to acknowledge receipt of your recent online appeal, on behalf of the driver, appealing against the issuing of a Parking Charge Notice (PCN) to the vehicle.

    We note your comments and must refer you to the Protection of Freedoms Act (PoFA) 2012, Schedule 4 - Recovery of unpaid Parking Charges. This is available to view online at:

    We now therefore request that the details of the driver of the vehicle at the time of the contravention are supplied; this must include their full name and serviceable postal address. Please note, Premier Park Limited will not reply to any correspondence until after the above date, if the requested information is not provided.
    If we do not receive this information by the date given, the registered keeper of the vehicle at the date of event will be held liable.

    I have had a bit of a browse and search. But I just want to make sure that I am not making a fatal mistake here.
    As I understand it, I do not pass on driver details, and await the NTK. Then I check that for compliance to PoFA 2012. If any errors are found, I fire off an email that I have caught them out, and get it cancelled. If not, I await a POPLA code, request a SAR from Premier Park, then go through their process.
    Have I missed something vital here? I'd rather not drag this on for too long, as much as I like to waste their time :)

    Oh were it so easy!

    If it fails PoFA, you construct your POPLA appeal effectively and you have an assessor who correctly understands PoFA, you might get it cancelled.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Okay, I did over simplify it a little :) But am I on the right track?
    I'm a worrier, and all this is starting to get to me a little. I'm not asking for all this to be handed to me on a plate, but that I am pointed in the right general direction. All your guys help is greatly appreciated.

    I have had my rejection from Premier park, and my Popla code. No sign of an NTK in the post yet tho. Should I now await that, or should I go ahead and request my SAR from Premier Park now? I have 28 days to start the POPLA appeal, or, should I start the Popla appeal before I get any NTK?
    Today is day 49 since the incident, with no NTK in the post. Or could the previous email be considered a NTK, as it states liability would be transfered to the registered keeper?

    Following is the latest email I was sent

    Thank you for your appeal, on behalf of the driver, against the above Parking Charge Notice (PCN). We have carefully considered your appeal, however on this occasion the appeal has been rejected for the following reason;

    The ticket on display is not valid for the car park in which the vehicle was parked. The signage on site clearly sets out the terms and conditions of parking and a ticket should have been purchased from the car park in which your vehicle was parked for it to be valid. As the ticket on display was not valid for where the vehicle was parked, we can confirm that this PCN has been issued correctly.

    You have now reached the end of our internal appeals procedure and therefore you now have two options; you can either pay or appeal to POPLA - you cannot do both:

    You can pay the total amount due as shown above via the following payment options;

    Call us on: 01302 513232
    Pay online: https://www.pcnpayments.com
    Send a postal order: Premier Park Ltd, PO Box 624, Exeter, EX1 9JG

    Or, you can appeal to an Independent Appeals Service, POPLA (Parking on Private Land Appeals) using the POPLA reference code provided above. Please note, should you decide to appeal to POPLA and your appeal is subsequently rejected or you withdraw your appeal, the option to pay a discounted amount will no longer be available and the full amount of the PCN will become due. Please note, if you pay the PCN prior to appealing to POPLA, your appeal will be withdrawn as you will have accepted liability in full.

    If you decide to appeal to POPLA, you will need to visit their website, https://www.popla.co.uk where further details of how to appeal (either online or by downloading the relevant forms) can be found. If you are unable to access their website, please call us for further information on how to obtain the forms. Please ensure your POPLA Reference Number, as noted above, is quoted on all correspondence to POPLA. You have 28 days from the date of this email to submit an appeal to POPLA. If you appeal to POPLA we will suspend recovery activity on the PCN and the charge will not increase until the appeal has been determined.

    By law we are also required to inform you that Ombudsman Services (https://www.ombudsman-services.org) provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to POPLA, as explained above.

    If you do not make payment or submit an appeal to POPLA within the relevant timeframe, the outstanding PCN may be passed to our appointed debt collection agency for further action. All costs associated with this process will be added to the amount outstanding.

  • So I couldn't appeal to Popla now, and state that I had not received the NTK before I was told to appeal to them?
  • Sorry, just wanted to bump this one. See if I can get in on a Popla Appeal before I get an NTK in the post, and claim no keeper liability now. Or, do I have to wait for the full number of days to pass to allow one to turn up if it is going to?
